Mr. Sinh would like to ask, is this regulation contrary to Article 8 of the Circular No. 40/2017 / TT-BTC of the Ministry of Finance?

Regarding this issue, The Ministry of Finance gives the following opinions:

Pursuant to Article 8 of the Circular No. 40/2017 / TT-BTC dated April 28, 2017 of the Ministry of Finance, stipulating business allowances and conference spending regimes:

"first. For communal officials who often have to go on mobile working for more than 10 days /month; officials of the remaining agencies and units must regularly go on mobile working for more than 10 days/month (such as: Documents; transaction accounting; forest rangers inspect forests; officials of the agencies involved litigation to investigate, supervise, verify, serve and other frequent traveling missions); then depending on the subjects, working characteristics and funding capability, heads of agencies and units shall set the monthly working-trip allowances for traveling working people to support car and petrol deposits according to VND 500,000 /person /month and must be stipulated in the internal spending regulations of the unit.

2. For subjects entitled to monthly working-trip allowances, if they are sent by competent authorities to perform tasks according to specific work trips, they shall be paid the working-trip allowances according to the provisions of this Circular ; At the same time, he will still be entitled to a monthly fixed working mission allowance if he is on a traveling mission for more than 10 days  month”.
