Mr. Hop asked, is the above bidding package identified as a bidding package providing consulting services for public investment projects?

Regarding this issue, the Ministry of Planning and Investment has the following opinion:

According to Clause 4, Article 4 of the 2023 Law on Bidding, consulting services are one or several service activities including: preparing and evaluating planning reports, master plans for development, architecture; surveying, preparing pre-feasibility study reports, investment policy proposal reports, investment policy approval documents, feasibility study reports, economic-technical reports, environmental impact assessment reports; surveying, designing, cost estimates; bidding consulting; consulting on examination and appraisal; consulting on supervision; consulting on project management; consulting on financial arrangement; auditing and other consulting services.

According to Clause 14, Article 4 of the Law on Public Investment, a public investment project is a project that uses all or part of public investment capital.

Accordingly, in case your bid package requires mobilizing experts to research, report and conduct land valuation, this is a consulting service bid package as stated in Clause 4, Article 4 of the Law on Bidding.

For bid packages that mainly mobilize personnel to perform logistics and organization, it is considered a non-consulting service bid package as stated in Clause 5, Article 4 of the Law on Bidding.
