Mr. Chuong inquires whether, in this case, his company is obligated to carry out product and packaging recycling responsibilities as per Decree No. 08/2022/ND-CP and whether these products are considered for the Vietnamese market.

The Ministry of Natural Resources and Environment responds as follows:

In Article 77, Clause 3 of Decree No. 08/2022/ND-CP dated January 10, 2022, issued by the Government, which details certain provisions of the Environmental Protection Law, it is stipulated that certain entities are not required to fulfill recycling responsibilities. This includes:

"Producers, importers of products and packaging for export or temporary import, re-export, or production and import for research, study, or experimentation as prescribed in Article 54, Clause 1 of the Environmental Protection Law."

It is recommended that the company review its import, production, and export activities to ensure compliance with the Environmental Protection Law and other relevant legal documents regarding product and packaging recycling.

In cases where difficulties or obstacles arise in complying with the provisions of the Environmental Protection Law on product and packaging recycling, it is suggested that the company submit a written request to the National EPR Council Office for assistance and guidance in accordance with its assigned functions and tasks (as per Decision No. 1090/QD-BTNMT dated May 4, 2023, by the Minister of Natural Resources and Environment).
