Article 42 of the Regulations on Management and Use of Apartment Buildings issued together with the consolidated document No. 05/VBHN-BXD on September 17, 2021 of the Ministry of Construction stipulates the rights and responsibilities of the management unit in operating the apartment building as follows:

1. Implement the management and operation of the apartment building in accordance with these Regulations and the signed service contract with the Apartment Building Management Board or the person in charge of managing the apartment building (for apartment buildings without an Apartment Building Management Board); perform maintenance of the common ownership part of the apartment building according to the maintenance contract if capable of maintenance.

2. Sign a supplementary contract with service providers in the management and operation of the apartment building (if any); supervise the provision of services by these units.

3. Notify in writing about the collection and payment of related expenses; notify the requirements and important information for residents in case of unexpected situations such as natural disasters, epidemics, fires; guide the installation of devices in the private ownership part of the owner.

4. Collect service management fees for operating condominiums according to agreements with owners and users of the condominiums; collect and pay remuneration to members of the Condominium Management Board according to the decision of the condominium meeting.

5. Report publicly on the management and operation of the condominium every six months or as required by the competent authority to the Condominium Management Board; report on the management and operation situation at the condominium meeting; gather feedback from users on the provision of condominium management and operation services.

6. Coordinate with the Condominium Management Board to address other related issues in the process of managing and operating the condominium.

7. Comply with decisions on resolution and handling of competent state agencies.

8. Implement other rights and responsibilities according to agreements in the condominium management and operation service contract or according to related legal regulations.

Therefore, the Condominium Management Board has the rights as stipulated above.
