The most complete application for unemployment insurance

Employees who are paying unemployment insurance are entitled to unemployment benefits when they fully satisfy the conditions prescribed by law.
According to the Vietnam Social Insurance, regarding the conditions for having unemployment insurance, according to the provisions of Article 49 of the Employment Law No. 38/2013/QH13 dated November 16, 2013, employees who are paying unemployment insurance are entitled to unemployment allowance benefits when fully meeting the following conditions:
Terminate the labor contract or work contract, except in the following cases, the employee unilaterally terminates the labor contract or work contract illegally; having monthly pension and allowance for loss of working capacity.
Having paid unemployment insurance for full 12 months or more within 24 months before terminating the labor contract or working contract, for the cases specified at Points a and b, Clause 1, Article 43 of this Law.
Or have paid unemployment insurance premiums for full 12 months or more within 36 months before terminating the labor contract, for the case specified at Point c, Clause 1, Article 43 of this Law.
Besides, the employee has submitted an application for unemployment benefits at the employment service center as prescribed in Clause 1, Article 46 of this Law.
In addition, the employee has not found a job after 15 days from the date of submitting the application for unemployment insurance, except for the following cases: Performing military service, police service; Going to study for a term of full 12 months or more; To abide by the decision to apply the measure of sending to reformatory, compulsory education institution, compulsory detoxification establishment; Being detained; serve prison sentences; Going abroad to settle down, going to work abroad under contracts; died.
Regarding the submission of application for unemployment benefits, in Clause 1, Article 17 of the Government's Decree No. 28/2015/ND-CP dated March 12, 2015 detailing a number of articles of the Employment Law on unemployment insurance. Unemployment insurance on submitting the application for unemployment benefits under the following provisions:
“Within 3 months from the date of termination of a labor contract or a working contract, an employee who has not had a job and wishes to receive unemployment benefits must directly submit 1 set of application for unemployment benefit in accordance with the provisions of Article 16 of this Decree to the Employment Service Center in the locality where the employee wants to receive unemployment benefits”.
