Does the allowance for non-specialized commune officials include social insurance and health insurance?

The Central Government's budget provides a fixed allowance fund, including support for social insurance (BHXH) and health insurance (BHYT) contributions, to be paid monthly to non-specialized workers at the commune level.

Mr. To Dien Truong (from Thua Thien Hue) is a non-specialized official at the commune level. Since March 2024, his agency has stopped supporting his social insurance and health insurance contributions. Every month, his social insurance and health insurance payments amount to 26.5% of his base salary, and the entire contribution is deducted from his allowance. Mr. Truong asked whether his agency's actions are correct and under which regulations this is applied.

Regarding this matter, the Ministry of Home Affairs responded as follows:

Article 34 of Decree No. 33/2023/NĐ-CP, dated June 10, 2023, of the Government on commune-level officials, civil servants, and non-specialized workers at the commune level, in villages, and in residential groups stipulates that the Central Government's budget provides a fixed allowance fund, including support for social insurance and health insurance contributions, to be paid monthly to non-specialized workers at the commune level.

At the same time, based on the allowance fund allocated by the Central Government for each commune level, the local budget allocated for wage policy reform, relevant legal regulations, and the specific characteristics of each commune, the Provincial People's Committee shall submit to the Provincial People's Council for specific regulations on monthly payments for non-specialized workers at the commune level in the province.

Based on the above regulations, on January 26, 2024, the People's Council of Thua Thien Hue Province issued Resolution No. 01/2024/NQ-HĐND, stipulating titles and allowance regimes for non-specialized workers at the commune level, in villages, and residential groups within the province. In particular, Article 2 of the Resolution specifically prescribes the titles and allowance levels for non-specialized workers at the commune level (this allowance level includes the funding for compulsory social insurance and health insurance contributions as required by social insurance and health insurance laws).
