When do I need to apply for a Certificate of Leave to Receive Social Insurance?

Ms. Nguyen Thao (Hanoi) asked, on the hospital discharge paper, there is a note that the employee is entitled to 10 days off work, so, do I need to request an additional Certificate of leave to receive social insurance to enjoy those 10 days?
Regarding this issue, Vietnam Social Security responds as follows:
In Clause 14, Article 1 of Circular No. 18/2022/TT-BYT dated December 31, 2022 of the Minister of Health amending and supplementing a number of articles of Circular No. 56/2017/TT-BYT dated December 29, 2017 of the Minister of Health detailing the implementation of the Law on Social Insurance and the Law on Occupational Safety and Hygiene in the health sector, it is stipulated as follows:
In case the patient needs to take leave for outpatient treatment after being discharged from the hospital, the Social Security agency shall base on the number of days off recorded in the note section of the discharge paper as the basis for payment of the Social Security regime according to regulations.
Comparing with the above regulations, the medical examination and treatment facility's addition of the number of days off for outpatient treatment in the notes section on the hospital discharge paper is in accordance with regulations and the number of days off for outpatient treatment will be used as a basis for the Social Insurance agency to resolve the Social Insurance regime for her according to regulations.
Therefore, she does not have to apply for an additional Certificate of Leave to Receive Social Insurance for the 10 days off for outpatient treatment mentioned above.
