The Ministry of Health responds regarding the group of officials eligible for a 100% allowance

Ms. Dinh Thi Thu Hoai (from Nghe An province) is a healthcare worker at the Vinh City Health Center in Nghe An province. Due to the impact of the COVID-19 pandemic, she was reassigned to a specialized position from 2020 to 2022. During this time, she directly collected samples from F0 and F1 cases in outbreak areas, monitored the health of foreign nationals in quarantine facilities, and collected community samples.

Ms. Hoai inquired about whether she is entitled to a 100% special allowance for her regular and direct work in COVID-19 prevention and control, similar to medical officers in preventive and grassroots healthcare.

In response to this matter, the Ministry of Health stated the following:

In accordance with Conclusion No. 25-KL/TW dated December 30, 2021, issued by the Party Central Committee: "Adjusting the regime of special allowances for medical officers in preventive and grassroots healthcare from 40-70% to 100%," the Government has issued Decree No. 05/2023/NĐ-CP. According to this decree, the special allowance for medical officers in preventive and grassroots healthcare will be applied from January 1, 2022, to December 31, 2023.

 - The 100% special allowance is applicable to medical officers who regularly and directly work in preventive healthcare (including border medical quarantine) and medical professionals at communal health stations, district-level and municipal healthcare centers, commune-level polyclinics, commune-level maternity clinics, district-level and municipal health centers under provinces, centrally-governed cities, and district-level and municipal hospitals under provinces, centrally-governed cities.

- During the period of applying the special allowance for medical officers in preventive and grassroots healthcare as stipulated in this Clause 7, the regulations in Point c of Clause 2 and the regulations concerning medical officers who regularly and directly work in preventive healthcare as stated in Clause 4, Article 3 will not be applied.

Accordingly, the individuals entitled to a 100% special allowance according to the provisions of Decree No. 05/2023/NĐ-CP are medical officers in preventive and grassroots healthcare who are currently receiving or have been receiving special allowances based on the profession ranging from 40% to 70% as stipulated in Decree No. 56/2011/NĐ-CP and Joint Circular No. 02/2012/TTLT-BYT-BNV-BTC dated January 19, 2012, issued by the Ministry of Health, Ministry of Home Affairs, and Ministry of Finance, guiding the implementation of Decree No. 56/2011/NĐ-CP (hereinafter referred to as Joint Circular No. 02/2012/TTLT-BYT-BNV-BTC).

Cases not falling under the scope of application of Decree No. 05/2023/NĐ-CP will continue to follow the special allowance regime based on the profession as stipulated in Decree No. 56/2011/NĐ-CP dated July 4, 2011, issued by the Government and Joint Circular No. 02/2012/TTLT-BYT-BNV-BTC dated January 19, 2012, guiding the implementation of Decree No. 56/2011/NĐ-CP dated July 4, 2011, issued by the Government, which regulates the special allowance regime based on the profession for civil servants and public employees working at public healthcare facilities (such as health education communication, population - family planning; administrative officials, and support staff not directly involved in medical specialization...).
