Proposed Policy Adjustments for Talent Attraction

According to the feedback from Ms. Nguyen Ngoc Anh (Hanoi), in order to be eligible for the talent attraction policy outlined in Decree No. 140/2017/ND-CP, one must meet the specified conditions regarding age and academic achievements.
However, based on the current Party and State regulations on recruiting civil servants and officials, in order to attract talented individuals, Ms. Anh suggests considering the removal of the age requirement specified in the Youth Law, which sets the age range from 16 to 30 for university graduates and individuals with master's degrees and under 35 for those with doctoral degrees.
Regarding this matter, the Ministry of Home Affairs responds as follows:
The government issued Decree No. 140/2017/ND-CP on December 5, 2017, to institutionalize the Party's policy of attracting and developing a pool of young and talented personnel from outstanding university graduates and young scientists. The age requirement serves the purpose of identifying, training, and nurturing talent from the high school level to create a long-term supply of leading experts in fields contributing to the socio-economic development.
Specifically, for outstanding university graduates and individuals with master's degrees, specialists with a level I specialization degree, and pharmacists with a level I specialization degree in the fields of medicine and pharmacy, Section 1 and Section 2 of Article 2 of Decree No. 140/2017/ND-CP stipulate an age range from 16 to 30 years old as specified in Article 1 of the Youth Law, as of the application submission date and meeting the prescribed criteria, making them eligible for the talent attraction policy.
For individuals with doctoral degrees, specialists with a level II specialization degree, and pharmacists with a level II specialization degree in the fields of medicine and pharmacy, Section 3 of Article 2 of Decree No. 140/2017/ND-CP stipulates an age requirement under 35 years old as specified in Article 23 of Decree No. 40/2014/ND-CP dated May 12, 2014, by the Government, which regulates the use and employment of individuals involved in scientific and technological activities (now amended by Section 3 of Article 1 of Decree No. 27/2020/ND-CP dated March 1, 2020), as of the application submission date and meeting the prescribed criteria, making them eligible for the talent attraction policy.
Regarding the proposal to remove the age requirement as suggested by Ms. Nguyen Ngoc Anh, the Ministry of Home Affairs will study and report to the competent authorities for consideration and decision during the process of reviewing and amending the talent attraction policy to align with current realities.
