Ms. Ton Thi Nguyet Van works at the Forest Protection and Development Fund of Quang Ngai Province. The Fund is an autonomous operator according to Decree 141/2016 / ND-CP, ensuring recurrent expenditures and operating funding from non-business revenues (10% is left from the revenue of forest environmental services) .

In the non-business collection activities, there is a part of the budget that has not been spent in 2017, Ms. Van's unit was allowed by the People's Committee of Quang Ngai Province to use this funding source to perform a number of tasks, including shopping. some properties for forest management station. However, due to the fact that the station has not been built yet, in 2017, assets have not been purchased (in 2018, the forest management and protection station was built).

Ms. Van would like to ask, does the asset procurement for the forest management and protection station have to carry out the centralized procurement process? If purchasing assets with the career development fund of the unit, does her unit carry out concentrated procurement?

Regarding this issue, The Ministry of Finance has the following opinions:

Under the Government's Decree No. 151/2017 / ND-CP dated December 26, 2017 detailing a number of articles of the Law on Management and Use of Public Assets, the concentrated procurement process applies to with assets on the list of concentrated procurement issued by the provincial People's Committee and under the concentrated procurement budget specified in Clause 2, Article 67 of Decree No. 151/2017 / ND-CP.

Therefore, she is requested to compare with the list of assets to be procured by the People's Committee of Quang Nam Province and the funding source to determine the appropriate procurement method.

In Article 70 of Decree No. 151/2017 / ND-CP stipulates:

“Article 70. Concentrated procurement funding

1. Funding sources for concentrated procurement: ...

dd) Funding from the public service development fund of a public non-business unit covered by the State;

2. In addition to the concentrated procurement funding sources specified in Clause 1 of this Article, ministers, heads of central agencies and chairmen of provincial People's Committees shall decide to use the following funding sources to ensure efficiency of purchasing assets in a concentrated manner:

a) Funding sources from the public service development fund of public non-business units cover part of the recurrent expenditure ”.

According to Article 70 of Decree No. 151/2017 / ND-CP, the public non-business unit's career development fund can ensure recurrent expenditure by itself, not belonging to the concentrated procurement budget.
