Is the market survey conducted by foreign organizations accepted in Vietnam?

The market survey results conducted by organizations established and operating in accordance with foreign laws are recognized in Vietnam. However, they must follow the legal procedures and formalities for consular legalization as prescribed in Decree No. 111/2011/NĐ-CP and Circular No. 01/2012/TT-BNG.

Ms. Pham Le My Tien raised a concern regarding advertising that uses words such as "best," "unique," "top," or similar expressions (as guided in Article 2 of Circular 10/2013/TT-BVHTTDL) under Article 8, Clause 11 of the Advertising Law. According to her, for advertisements to use such terms, they must be based on market surveys conducted by legally established organizations with market research functions.

Ms. Tien asked whether the market survey results conducted by organizations established and operating in accordance with foreign laws are accepted in Vietnam. If they are accepted, she inquired about the required documentation and procedures for recognition and usage in Vietnam.

Regarding this issue, the Ministry of Culture, Sports, and Tourism responded as follows:

According to the regulations stated in Article 2 of Circular No. 10/2013/TT-BVHTTDL dated December 6, 2023, issued by the Ministry of Culture, Sports, and Tourism, the market survey results conducted by legally established organizations with market research functions are considered legal documents that prove the content of advertising using phrases such as "best," "unique," "top," or similar expressions.

The market survey results conducted by organizations established and operating in accordance with foreign laws are accepted in Vietnam. However, they must follow the legal procedures and consular legalization as prescribed in Government Decree No. 111/2011/NĐ-CP dated December 5, 2011, which regulates consular certification and consular legalization, and Circular No. 01/2012/TT-BNG dated March 20, 2012, issued by the Ministry of Foreign Affairs, providing guidelines for the implementation of certain provisions of Government Decree No. 111/2011/NĐ-CP dated December 5, 2011, regarding consular certification and consular legalization.
