Ms. Thuy Duong (in Vinh Phuc Province) would like to ask, how is the consultancy package different from the procurement package? What is the procedure for selecting a "qualified contractor"? Is the bidding package price of less than VND 100 million required to apply the 3 quotation forms?

The Ministry of Planning and Investment answers this issue as follows:

Clause 8 and Clause 25 Article 4 of the Bidding Law stipulates that consultancy services are one or several activities, including:

- Making and evaluating planning reports, overall development planning, architecture;

- Survey, prepare pre-feasibility study report, feasibility study report, environmental impact assessment report;

- Survey, design, cost estimation;

- Preparing the invitation for expression of interest, prequalification documents, bidding documents, request for proposals;

- Evaluation of interest, prequalification, bid, proposal;

- Verification and evaluation;

- Monitoring;

- Project management;

- Financial arrangement;

- Auditing, training and technology transfer;

- Other consulting services.

Goods include machinery, equipment, raw materials, fuels, materials, supplies and spare parts; consumer goods; medicine, medical supplies used for medical establishments.

Regarding Ms. Duong's problem, the determination of the procurement package of goods and consultancy service bidding packages are based on the above provisions.

In addition, for the procurement package of goods and consultancy packages with bidding package price of no more than VND 100 million, the form of direct appointment of contractor shall be applied according to the abbreviated process in Article 56 of Decree No. 63/2014 / ND. -CP by the Government.
