Previously, Mrs. Vy's company completed the registration of business sectors and professions for automobile agency activities as follows:

-  Business sector and profession name: Automobile and other motor vehicle dealers; details: Commission agent service (CPC 61111);

-  Industry code: 4513.

Currently, the company has a need to add brokerage activities for used cars. Specifically, the actual business activity of the company is to act as an intermediary for suppliers, individuals, and enterprises providing used cars (suppliers) and individuals, organizations in need of purchasing used cars (customers).

Accordingly, the company introduces customers to corresponding suppliers according to the requirements of the customers and/or vice versa. When the transactions are successful, the company will receive commission for this introduction.

With the actual business operation needs of the company as described above and in reference to Decision No. 27/2018/QD-TTg dated July 6, 2018, of the Prime Minister on the issuance of the system of Vietnam's economic sectors, the company finds it appropriate to register the brokerage activities for used cars into the business sector and profession with VSIC code 4513.

Therefore, the company has carried out additional registration of business sectors and professions with the Business Registration Office as follows:

-  Modified business sector and profession name: Automobile and other motor vehicle dealers; details: Commission agent service (CPC 61111), brokerage activities for used cars;

-  Industry code: 4513.

However, the Business Registration Office issued a notice regarding the modification and supplementation of the business registration dossier, requesting the company to amend and supplement the dossier as follows:

"The Business Registration Office requests the enterprise to adjust the details of the intended business sector and profession to supplement the "Brokerage activities for used cars" into industry code 7490 (Other professional, scientific, and technical activities not elsewhere classified) with details as follows: Details: Commercial brokerage activities."

Ms. Vy asked, with the goal of conducting brokerage activities for used cars as mentioned above, which VSIC code is suitable for the company to register its business sector and profession?

Regarding this issue, the Ministry of Planning and Investment responded as follows:

According to the regulations in Article 1, Clause 7 of Decree No. 01/2021/ND-CP dated January 4, 2021, of the Government on enterprise registration, the business registration authority is responsible for guiding, comparing, and recording the business sectors and professions of enterprises into the national database on enterprise registration.

Therefore, in cases where enterprises encounter difficulties in determining their business sectors and professions when registering to establish enterprises, supplementing notifications, changing business sectors and professions, or requesting changes to their Business Registration Certificate, enterprises are requested to contact the Business Registration Office under the Department of Planning and Investment for guidance and clarification.

In cases where the business sector and profession are not included in the Vietnam Standard Industrial Classification (VSIC) system and are not regulated by other legal documents, the business registration authority will consider recording this business sector and profession into the national database on enterprise registration if it does not fall under prohibited business sectors and professions, and at the same time notify the Ministry of Planning and Investment (General Statistics Office) to supplement new business sectors and professions as regulated in Clause 5, Article 7 of Decree No. 01/2021/ND-CP of the Government.
