According to Circular No. 04/2019/TT-BVHTTDL dated July 17, 2019 of the Minister of Culture, Sports and Tourism promulgating the list of sports activities requiring a training instructor, the list of adventure sports, there are 9 sports in the list.

Ms. Lan asked, if a business wants to carry out procedures to request a Certificate of eligibility to conduct sports activities that are not on the list requiring an instructor (for example: soccer, billiards, gym, etc.), is it required to have a Certificate of professional competence of the instructor when submitting the application?

If you are an individual business household when doing business in sports activities (not included in the list of extreme sports that must be registered as an enterprise) such as: yoga, bodybuilding, billiards..., do you need to go through the procedures to obtain a Certificate of eligibility for sports business, or do you just need to meet the conditions according to Circular No. 04/2019/TT-BVHTTDL?

Regarding this issue, the Ministry of Culture, Sports and Tourism responded as follows:

According to the provisions of the Law on Physical Training and Sports and Decree No. 36/2019/ND-CP dated April 29, 2019, when conducting sports business, enterprises must have facilities and equipment according to the regulations of the Ministry of Culture, Sports and Tourism and must be granted a Certificate of eligibility for sports business. In case a hotel organizes sports service business activities, it must meet the above regulations.

Business conditions of a sports business enterprise include: having a team of professional staff suitable for the content of the activities; having facilities and equipment meeting the requirements of sports activities.

Therefore, if a business wants to carry out the procedure to request a Certificate of eligibility for sports activities that are not on the list of sports that require an instructor, for example: football, billiards, gym, etc., when submitting the application, it must have a Professional Certificate of a sports instructor that is suitable for the business activities. The standards for sports instructors are implemented according to Clause 1, Article 13 of Decree No. 36/2019/ND-CP. Circular No. 04/2019/TT-BVHTTDL of the Minister of Culture, Sports and Tourism promulgates the list of sports activities that require an instructor, the list of adventure sports, and stipulates 9 sports (in the list). For adventure sports and sports activities requiring instructors, it is necessary to register to establish a business and meet all the conditions for doing business in adventure sports and sports activities requiring instructors according to the provisions of the Law on Physical Education and Sports and Decree No. 36/2019/ND-CP.

Individual business households when doing business in sports activities do not need to apply for a Certificate of eligibility to do sports business.
