(Chinhphu.vn) –The implementation of the bidding package requires the capacity and experience of the expert, which is classified as a consultancy package, otherwise if it is not required, it shall be classified as a non-consulting service package.

Mr. Le Cao Tri’s unit (in Ho Chi Minh City) is aprocuring entity that is in need of implementing the bidding package for rentingservices of telecommunications column quality inspection in the area, the specific contents are as follows:

- Preparations for data collection

- Making inspection outline

- Measuring and surveying antenna column structure parameters

- Analyzing and evaluating structural safety

- Making reports on verification and certification of sufficient safety for antenna tower construction.

The contents are implemented in accordance with the Decision No. 55 / QD-BXD dated January 25, 2017 of the Ministry of Construction. Mr. Tri asked, is the above inspection a consulting or non-consulting service?

Regarding this issue, The Ministry of Planning and Investment has the following opinions:

In Clause 8 and Clause 9, Article 4 of the Bidding Law stipulates that consulting services are one or several activities including:

• Preparation, assessment of the planning report,

-     Overall development diagram, architecture;

-     Survey and making of pre-feasibility study report,

-     Feasibility study report, environmental impact assessment report;

-     Survey and making of engineering, estimate;

-     Preparation of dossiers of invitation for expression of interest, dossier of invitation for pre-qualification, bid documents, dossiers of requirements;

-     Assessment of dossiers of expression of interest, dossiers of prequalification participation, bids and proposal dossiers

-     Verification and appraisal;

-     Supervision;

-     Management of project;

-     Arranging finance;

-     Audit, training, transfer of technologies;

-     Other advisory services.

 Non-advisory service means one or a number of activities including: Logistics, insurance, advertisement, installation that not belong to Clause 45 of this Article, pre-acceptance test and operation run, holding of training, maintenance, drawing maps and other activities not being advisory services defined at clause 8 of this article.

For Mr. Tri's case, the classification of the bidding package shall comply with the above provisions. Accordingly, in case the implementation of the bidding package requires the capacity and experience of experts, it is classified as a consultancy package.

In case there is no requirement for professional capacity and experience, it is classified as a package of non-business services.
