Incessantly attending school for over 3 months without enjoying vocational allowances

However, the Department of Finance did not settle this allowance, resulting in a recollection of the amount he had received. Mr. Minh asked if this was in accordance with regulations.

Regarding this issue, the Ministry of Health responded as follows:

According to Article 3 of Inter-ministerial Circular No. 02/2012/TTLT-BYT-BNV-BTC issued by the Ministry of Health, the Ministry of Home Affairs, and the Ministry of Finance, guiding the implementation of Decree No. 56/2011/NĐ-CP dated July 4, 2011, of the Government on the regime of preferential allowances based on professions for civil servants and officials working in public health establishments, the following situations are not eligible for vocational allowances:

- The period of overseas business trips, work assignments, or study, during which they receive 40% of their salary according to the regulations stipulated in Clause 4 of Article 8 of Decree No. 204/2004/NĐ-CP;

- The period of continuous domestic study for more than 3 months without directly performing medical tasks as assigned to civil servants and officials;

- The period of continuous leave without salary for 1 month or more;

- The period of leave with social insurance benefits according to the provisions of the law on social insurance;

- The period of temporary detention, temporary suspension of work, or temporary suspension of medical duties for 1 month or more;

- The period of being authorized by competent authorities to go on business trips or work assignments without directly performing medical tasks for 1 month or more.

Therefore, the period of continuous training lasting over 3 months according to the decision of the competent authority, without directly performing medical tasks as specified in the job position and assigned tasks for civil servants and officials at the appropriate level, is not eligible for vocational allowances based on medical professions.
