Manufactured products that have been certified with conformity certificate (according to the validity of the conformity certificate to September 5, 2018) are allowed to continue to be circulated, without reapplying for conformity certificate or declaration of conformity. 

Pursuant to the Consolidated Document 05 / VBHN-BKHCN of the Ministry of Science and Technology detailing the regulations of announcement of standard conformity, announcement of technical regulation conformity and methods of assessing the standards and conformity of products, products subject to compulsory conformity and Declaration of Conformity certification shall be certified with conformity certificate and Declaration of Conformity certificate and labeled with conformity marking before being circulated in the market.

Pursuant to this provision, through the receiving and responding system to businesses’ recommendations, the Aeon Vietnam Co., Ltd. Would like to ask: “Are the following 3 cases considered valid or not?”

1. Imported goods registered with a specialized agency were cleared of customs clearance and certified with conformity certificate with validity until September 5, 2018. After September 5, 2018, are these imported products allowed to be circulated or does the company have to re-apply for conformity certificate and announcement of conformity?  

2. Imported or domestically manufactured goods registered with a specialized agency were cleared of customs clearance and the enterprise obtained conformity certificate of the batch of products issued on  August 31, 2018. This certificate has no expiry date; does it mean that this shipment is circulated until the company proactively suspends its business?

3. Domestically manufactured goods that were certified with conformity; and the expiry dates were September 5, 2018. After September 5, 2018, are products manufactured before this date and labeled with conformity marking allowed to be circulated? or may new certificates and announcement of conformity be re-issued from the beginning?

Regarding this issue, the Ministry of Science and Technology gives the following opinion:

Regarding case 1, we request the Company to clarify that this case is to perform conformity certification under which methods specified in Circular No. 28/2012 / TT-BKHCN dated 12/12/2012 of the Ministry of Science and Technology.

In accordance with method 7 to assess the conformity of a batch of imported goods, the Type Approval certificate is valid to a batch of imported goods, having no valid period as stated by the enterprise. In this case, the goods that were certified with conformity, announced the conformity by batch will continue to be circulated. The company does not have to reapply for assessing the conformity or announcement of conformity.

In case of assessing the conformity certification in the country of origin (evaluation at source) under method 5 (may have the validity period as stated by the enterprise), the goods have been certified with conformity and announced. Conformity can continue to circulate, do not have to evaluate the certificate of conformity and announce of the conformity.

For case 2, products and goods that are domestically produced and imported that have been granted regulation conformity certificates by consignment may continue to be circulated on the market. However, only applies to products and goods in the same consignment certified conformity, not to products and goods of others.

For case 3, products manufactured and certified with conformity (according to the validity of the certificate of conformity to September 5, 2018) are allowed to continue being circulated, without having to reapply for conformity certificate or announcement of conformity certificate.
