Mr. Tran Van Huy's unit (in Quang Binh Province) is bidding for a consumables package in the form of 1 stage – 2 envelope bidding. After evaluating technical proposals, it is the evaluation of financial proposals.

However, when evaluating the validity of the financial proposal dossier, there is a case where the bidding application of contractor A has a bid price of VND 50 billion, while the detailed price list is VND 5 billion. The rest of the bidding application is appropriate. The bid evaluation team allows the bidder to clarify the bid application. Mr. Huy would like to ask, is it true according to the law?

Regarding this issue, The Ministry of Planning and Investment has the following opinions:

Point b, Clause 2, Article 30 of the Government's Decree No. 63/2014 / ND-CP stipulates that one of the evaluation contents of the validity of the financial proposal dossier is that it has a tender application in the financial proposal dossier signed and sealed by the contractor's legal representative (if any) upon request of bidding documents; The bidding prices inscribed in the bidding applications must be specific, fixed in numbers, letters and must be suitable and logical with the total bidding prices stated in the general price list, not proposing different bidding prices or enclosed unfavorable conditions for investors and bid solicitors.

For a partnership of contractors, the bid application must be signed and stamped by the lawful representative of each partnership member (if any) or the head of the partnership shall sign the tender application on behalf of the partnership according to responsibilities assignment in joint venture agreement documents.

For Mr. Huy's matter, the evaluation of bids shall comply with the above provisions.
