Headquarters located in particularly difficult hamlet areas are entitled to preferential treatment

Mr. Nguyen Trung Kien (Tuyen Quang) is a civil servant at the Financial - Planning Department under the district People's Committee. Mr. Kien has requested clarification on the implementation of the policies stipulated in the Government's Decree No. 76/2019/ND-CP dated October 8, 2019, concerning the special difficult hamlet areas in Area I of a commune.

Specifically, one commune in Mr. Kien's district has been recognized as a new rural commune according to the decision of the provincial People's Committee Chairman dated May 25, 2022. Therefore, this commune is identified as an Area I commune according to the provisions in Article 3 of the Prime Minister's Decision No. 861/QD-TTg dated June 4, 2021:

"Communes in Area III, Area II that have been approved in this Decision, if recognized as new rural communes, will be designated as Area I communes and will cease to enjoy policies applicable to Area III, Area II communes from the date of the Decision of the competent authority recognizing the commune as a new rural commune takes effect." Prior to that, the commune belonged to Area III as per Decision No. 861/QD-TTg.

However, up to now, the hamlets within the commune's territory are still considered special difficult hamlets according to Decision No. 612/QD-UBDT dated September 16, 2021, of the Committee for Ethnic Minorities (without any amendments or supplements). The special difficult hamlets still fall within areas of particularly difficult economic and social conditions according to Clause 2, Article 1 of Decree No. 76/2019/ND-CP dated October 8, 2019, of the Government.

Mr. Kien asks whether the officials and civil servants currently working in the commune are eligible for and can count the time to receive allowances and subsidies according to Decree No. 76/2019/ND-CP.

Regarding this matter, the Ministry of Home Affairs responded as follows:

Based on the provisions of Clause c, Article 1, Point 2, Decree No. 76/2019/ND-CP dated October 8, 2019, of the Government on policies for officials, civil servants, public employees, laborers, and those receiving salaries in the armed forces working in areas of particularly difficult economic and social conditions, the case of officials, civil servants, and public employees working in the actual administrative area of a particularly difficult hamlet (the headquarters of the agency or unit located in the area of a particularly difficult hamlet according to the decision of the competent authority) falls within the scope of the policy specified in Decree No. 76/2019/ND-CP.

The organization and implementation of policies for officials and civil servants in Tuyen Quang province fall under the jurisdiction of the provincial People's Committee. Therefore, Mr. Nguyen Trung Kien is requested to contact the agency responsible for managing officials and civil servants in Tuyen Quang province (Department of Home Affairs) for further clarification.
