Does the project implementation time need to be adjusted?

The construction project of the state agency's office managed by Ms. Nguyen Thi Yen (Bac Ninh) falls under the mid-term public investment program, categorized as Group B projects. The project implementation period, as approved by the investment decision and the project approval decision, was until December 31, 2022.

As of now, the project has been substantially completed in accordance with the approved contents by the competent authority. However, procedures for settling land clearance, acceptance of the completed construction work, and finalizing the project with relevant functional agencies have not been carried out due to the expiration of the project implementation time (without any adjustments to objectives, scope, scale, or increased total investment).

So, does the investor need to extend the project implementation time and submit the adjusted investment decision to the competent authority?

The Ministry of Construction responded to this issue as follows:

According to the regulations in Clause 1 of Article 4 of Decree No. 15/2021/NĐ-CP dated March 3, 2021, of the Government, which details some provisions on the management of investment projects in construction, the work of accepting the completion of construction works, and the handover of completed construction works for use during the project implementation phase, and the work of settling completed projects at the end of the construction phase of the project:

The project investor shall base on the current regulations to adjust the project implementation time as the basis for carrying out the work of accepting the completion of construction and project settlement according to the prescribed procedures.

The adjustment of the investment decision for the above-mentioned project (if any) shall be considered and implemented in accordance with the laws on public investment. The investor is advised to contact the Ministry of Planning and Investment for further guidance.
