(Chinhphu.vn) - Mr. Trinh Ngoc Tu’s Unit (in Thai Nguyen Province) is the investor of a 2-step design package, showing the bid package that needs to be adjusted to ensure the quality related to geology.

Mr. Tu referred to Articles 82 and 84 of the Construction Law, found that the regulations of specialized agencies and investment deciders approved, but according to Article 17 of the Circular No. 18/2016 / TT-BXD, the investor approved adjust construction drawing design.

Mr. Tu asked, which agency will approve (the investor or investment decision maker) adjust the construction drawing design without changing the project but related to geology?

The Ministry of Construction responds this issue as follows:

In case of adjusting geological drawing design related to geology in a two-step design package to ensure quality, but not leading to adjustment of construction investment project, it shall be decided and approved by the investor and be responsible for their adjustment decisions in accordance with Clause 2 and Clause 5, Article 17 of the Construction Ministry's Circular No. 18/2016 / TT-BXD of June 30, 2016, detailing and guiding some contents on project appraisal, approval and construction design as well as cost estimates.

The investor shall have to report to the investment decider on the content of the construction design adjustment decided by him / her.
