Does an industrial park infrastructure project need an environmental permit?

Mrs. Nhu Quynh's company (in Da Nang) is the investor in the industrial park infrastructure. The project previously had an area of 650 hectares and had a decision approving the environmental impact assessment report in 2019.

In the approved content of the project's environmental impact assessment, there is a wastewater treatment station, but currently, due to the low amount of wastewater generated, it is temporarily being diverted to the common wastewater treatment station of the Industrial Park Management Board (with an agreement document allowing temporary connection).

So far, the project area has been reduced to only 320 hectares, and the land allocated for technical infrastructure to build the wastewater treatment station is within this reduced area. Mrs. Quynh's company is in the process of adjusting the planning.

Mrs. Quynh asked whether the project could skip building the wastewater treatment station and instead apply for permission to collect and connect wastewater to the existing nearby treatment station. Emissions, solid waste, hazardous waste are all managed by investors in the industrial park. In the event of not building the wastewater treatment station, does the project need to obtain an environmental permit under the Environmental Protection Law 2020?

The Ministry of Natural Resources and Environment responds to this issue as follows:

Point a, Paragraph 1, Article 51 of the Environmental Protection Law stipulates that industrial parks must have a centralized wastewater collection, drainage, and treatment system.

Accordingly, industrial parks are subject to the requirement of obtaining an environmental permit as prescribed in Article 39 of the Environmental Protection Law.
