The timeframe for contract execution is the number of days calculated from the effective date of the contract until the parties fulfill their obligations as stipulated in the contract, excluding the warranty period (if any).
Mr. Nguyen Ngoc Than Tuy's company (Ba Ria-Vung Tau) is currently organizing online bidding. However, the company is facing difficulties related to the timeframe for contract execution according to Clause 7 of Article 35 of the Bidding Law.
Mr. Tuy inquired whether the timeframe for contract execution, as defined in Clause 7 of Article 35 of the Bidding Law, includes the obligation of payment from the investor/contracting party to the contractor.
The company understands that the timeframe for contract execution only includes the time for the contractor to perform the work from the effective date of the contract until the date when both parties sign the acceptance minutes for the completed work under the contract. Is this correct to understand that way?
The Ministry of Planning and Investment responded to this issue as follows:
According to the regulations stated in Clause 7 of Article 35 of the Bidding Law, the timeframe for contract execution is the number of days calculated from the effective date of the contract until the parties fulfill their obligations as stipulated in the contract, excluding the warranty period (if any).
Accordingly, the determination of the timeframe for contract execution is based on the aforementioned regulations.
Payment is to be made according to the terms specified in the contract.
