The Chau Dai Duong Trading and Service Company has just signed a labor contract (labor contract) with 2 employees:

1.Ms. Ngo Thi Lien: Having a diploma of a "Beauty care" vocational college diploma, a "nail art and painting" vocational skill certificate issued by the Hanoi College of High Technology and certificates of foreign and computer science linguistics and vocational pedagogical certificates that teach vocational secondary education and other vocational colleges.

2. Mr. Le Ngoc Anh: Graduated with a bachelor's degree in "beauty aesthetics" from the University of Health and Welfare - Dongshin University (Korea), with a full range of computer, foreign language, teaching certificates. vocational training at intermediate vocational level and other vocational colleges.

On June 7, 2018, the Company submitted a dossier of registration for vocational education activities of elementary level to the Department of Labor, War Invalids and Social Affairs of Hanoi City. On June 18, 2018, the Company received a report card proposing resolution of documents of Vocational Training Department, Department of Labor, War Invalids and Social Affairs. In Hanoi, the teacher Ngo Thi Lien taught nail art with professional qualifications that was not suitable for the registered profession (specifically, College of Beauty Care).

On June 26, 2018, after supplementing the dossier, the Company received an instruction to complete the dossier with the content: Teacher Le Ngoc Anh who did not meet the training standards, received training of Hair stylist subject with 3 credits, the amount of credits trained is relatively small compared to the training time of 322 hours according to a training program built by the Company.

Pursuant to Article 3 of the Circular No. 08/2017 / TT-BLDTBXH of the Ministry of Labor, War Invalids and Social Affairs dated March 10, 2017, the regulations on qualifications of primary-level teachers are as follows: “Having a vocational intermediate or intermediate or higher degree, a training discipline relevant to the teaching profession or one of the vocational skill certificates relevant to the teaching profession to teach the qualification elementary level: National occupational skill certificate of grade 1 or worker certification of 3/7, 2/6 or artisan certificate of a province, a city directly under the Central Government or equivalent or higher ”.

According to the Company, the industry "Beauty care" or "Beauty cosmetology" is a wide field, including skin care, hair care / hair styling, art makeup, nail care / drawing. art…. The training majors of the two teachers mentioned above are suitable with the registered teaching profession.

On the other hand, the Company does not find any legal basis: In the process of teachers studying at intermediate / college / university levels, the subjects that teachers are teaching must be trained at least how many credits to be allowed teaching conduction.

The Oceania Trade and Service Company asked for the answers, the two workers mentioned above have fully met the qualification standards of elementary-level teachers related to beauty / beauty care? Does Ms. Ngo Thi Lien fully meet the qualification standards for teaching the elementary level of Nail Art and Mr. Le Ngoc Anh has met the qualification standards for teaching primary skills. Modeling hair?

Regarding this issue, The General Department of Vocational Education, Ministry of Labor, War Invalids and Social Affairs answered as follows:

Reviewing teacher records, Ms. Ngo Thi Lien has a vocational college diploma in "Beauty Care"; vocational certificate of "Drawing nail art" issued by Hanoi High-Tech Vocational College (training period of 2 months). In the vocational college training program, there is a basic Nail Art course. Mr. Le Ngoc Anh has a bachelor's degree in "Beauty cosmetology" from the University of Health and Welfare - Dongshin University, Korea. In the university-level training program, there are subjects: basic cutting and hairstyling.

Considering the practical training in the field of cosmetic services, currently, according to the provisions of the Circular No. 04/2017 / TT-BLDTBXH dated March 2, 2017 of the Ministry of Labor, War Invalids and Social Affairs promulgating the List training lines and occupations of Level IV of intermediate level, college level, intermediate level, a group of Cosmetology services training 4 occupations: Beauty services (Code 5810401), Modeling and care beauty (Code 5810402), Hair care technology (Code 5810403), Beauty care (Code 5810404).

For career college training: Beauty Care (Code 6810404).

According to the provisions of the Circular No. 24/2017 / TT-BGDDT dated October 10, 2017 of the Ministry of Education and Training promulgating the list of Level IV education and training at university level, cosmetic services in the list of university education.

Thus, the domestic training in cosmetology services is still limited, especially at the college and university level, while the training of professions in the elementary level of cosmetic services is very diverse.

Pursuant to Clause 1, Article 3 of Circular No. 08/2017 / TT-BLĐTBXH dated March 10, 2018 of the Ministry of Labor, War Invalids and Social Affairs providing professional standards for teachers vocational education; review of domestic practice in the field of Intermediate, College and University training in Cosmetology Services, document review and training courses in Beauty Care and Beauty Salon, Ms. Ngo Thi Lien is qualified to teach a beginner-level nail art and Le Ngoc Anh is qualified to teach a beginner-level hair stylist.
