According to Mr. Nguyen Duc Thien's feedback (Vinh Phuc), currently, the selection of the organization to conduct land use rights auctions for land allocation and land leasing to households and individuals is carried out by the People's Committees of communes and towns, with the district People's Committee assigning the Department of Natural Resources and Environment to execute this task. However, difficulties and complications arise when making payments to the auction organizing unit.

Mr. Thien questioned whether it is in accordance with regulations for the district-level People's Committee, acting as the investor for communes and towns, to sign contracts with the auction organizing unit, while the payment of auction organization fees is the responsibility of the commune-level People's Committee.

According to the regulations, the entity that signs the contract is responsible for payment. In this case, if the district-level People's Committee makes the payment, it cannot use funds from the land use rights auction revenues at the district level to cover expenses (as stipulated by the source of land use rights auction revenues used for investment and development).

Mr. Thien also asked if the district People's Committee can delegate authority to the commune-level administration to carry out the selection and signing of contracts with the auction organizing unit.

The Ministry of Natural Resources and Environment, in coordination with the Ministry of Justice, has issued Joint Circular No. 14/2015/TTLT-BTNMT-BTP, which stipulates the organization of land use rights auctions for land allocation and land leasing with land use fees. This circular contains specific provisions regarding the sequence and procedures for organizing land use rights auctions.
