Implementation of the Resolution of the XIIth Party Congress, in order to fulfill the objectives and targets for socio-economic development in the stage of five years from 2016-2020 approved by the National Assembly, Vietnam must accelerate economic restructuring, improve the quality of growth and development in depth based on knowledge of the innovation, the science and the high technology, in which enterprises, especially private enterprises are the driving forces for enhancing competitiveness and autonomy of the economy.

Resolution

ON ASSISTANCE AND DEVELOPMENT OF ENTERPRISES TILL 2020

GOVERNMENT

Pursuant to the Law  dated June 19, 2015 on Organizational Government;

Pursuant to the National Assembly's Resolution No. 142/2016 / QH13 dated April 12, 2016 on the five-year socio-economic development plan from 2016-2020;

Based on discussion and voting by cabinet’s members and the Prime Minister's conclusion at the regular Government meeting in April 2016,

PROTOCOL

Implementation of the Resolution of the XIIth Party Congress, in order to fulfill the objectives and targets for socio-economic development in the stage of five years from 2016-2020 approved by the National Assembly, Vietnam must accelerate economic restructuring, improve the quality of growth and development in depth based on knowledge of the innovation, the science and the high technology, in which enterprises, especially private enterprises are the driving forces for enhancing competitiveness and autonomy of the economy.

The Government requests the ministries, the ministerial-level agencies, the agencies belong to the Government, the People's Committees of the provinces and cities which directly under the Central Government to direct, manage and organize the effective implementation of the objectives and principles, tasks and solutions as follows:

OBJECTIVES AND PRINCIPLES

  1. Objectives:

By 2020, to develop Vietnamese enterprises with competitive capacity and sustainable development, the whole country shall has at least 1 million operating enterprises that include large-scale enterprises with strong resources. Vietnamese private area contributes about 48-49% of GDP, take about 49% of total social investment. Total factors productivity (TFP) contributes 30 to 35% of GDP. The social labor productivity increases about 5% per year. Every year, There are about 30 - 35% of Vietnamese enterprises which have the innovative activities.

  1. Principles:

To build and complete economic institutions and create a favorable business environment for enterprises to develop and become a driving force of the economy, the following principles should be ensured:

  1. a) The State protects the lawful ownership of property and business freedom of people and enterprises in accordance with the law. Enterprises have the right to freely conduct business in lines that are not prohibited by law.
  2. b) To implement the State policy of creating and using enterprises as service objects, to create favorable conditions for enterprises to make investment, business and development in order to formulate, promulgate and organize the implementation of law provisions on related enterprises.
  3. c) The state ensures the stability, consistency and predictability of the policies; to stabilize the macro economy, to improve the business environment in a convenient, safe and friendly manner.
  4. d) State guarantees equal rights to all enterprises regardless of their types and economic sectors in accessing resources such as capital, resources, land and business investment.
  1. đ) State has specific policies to support the small and medium enterprises, the start-up enterprises, the innovative and have high growth potential enterprises.
  2. e) When issuing and enforcing policies, State management agencies must ensure that each task has a lead and responsible person.
  3. g) The provisions on business conditions must be clear, transparent, easy to implement and have an appropriate roadmap for early abandonment of unlicensed sub-licenses, fees and surcharges. To improve the efficiency of state management in the orientation of simplifying pre-inspection, strengthening post-inspection and attaching to specific conditions and regulations in the inspection, the examination and the supervision.
  4. h) The inspection, the examination and the supervision work must ensure the objectives of preventing, detecting and handling violations while at the same time assisting and guiding enterprises in complying with the provisions of law.
  5. i) Do not criminalize economic and civil relations, and strictly handle all violations of the law.
  6. k) Enterprises must raise the spirit of national pride, the sense of law observance, the integrity of business; the development of corporate culture, the entrepreneurial ethics and the corporate social responsibility; the healthy competition, the sharing and cooperation; the innovation; enhance competitiveness capacity.

 

  1. DUTIES AND SOLUTIONS
  2. Administrative reform and facilitate enterprises
  3. a) The ministries, the ministerial-level agencies, the agencies belong to the Government, the People's Committees of the provinces and centrally-run cities and concerned agencies:

-To seriously implement the Government's Resolution No. 19/2016 / NQ-CP dated April 28, 2016 on major dutiess and solutions to improve the business environment and raise the national competitiveness for two years. From 2016 - 2017, orientation till 2020 and direction of the Government’s Prime Minister in Announcement No. 66 / TB-VPCP dated April 27, 2016 on the implementation of the Law on Enterprises and the Law on Investment.

- To Seriously implement the Government's Resolution No. 36a / NQ-CP dated October 14, 2015 on e-Government for publicity and transparency in order to create conditions for enterprises to supervise State agencies through network environment; to open an specialized section about business development support on the website. To publicize the process, procedures and business conditions (if any), results of settlement of recommendations and complaints of enterprises on the website of their own agencies and units.

- To seriously implement the Decision No. 225 / QĐ-TTg dated 4 February 2016 of the Government’s Prime Minister  approving the plan for State administrative reform in stage of 2016-2020.

- To train and foster for raising the level and morality of the contingent of cadres, civil servants and public employees to ensure that they have good qualities and capabilities to perform their tasks in the sense of assisting enterprises.

  1. b) President of People's Committees of provinces and cities under central authority:

-  To organize public dialogues at least twice a year with the business community and press to catch up and solve difficulties and problems for enterprises in the area.

- To set up and publicize the hotline, online questions and answers on the E-portal of provincial and city for receiving feedback, guidance and responses for enterprises.

- To direct and take the responsibility to promote the effective implementation of the Decision No. 09/2015 / QD-TTg dated May 23, 2015 of the Government’s  Prime Minister's promulgating the Regulation on implementation of the "one door mechanism",interconnected door mechanism at local state administrative agencies. To review and unify the focal point for receiving and processing dossiers; to guide and resolve administrative procedures for enterprises on the principle that upon requesting amendments and supplements to dossiers, to notify one time in writing to enterprises and investors for all contents which need to be amended or supplemented for each dossier. The notice must clearly state the request for amendment, supplements and the reason for the request of amendment and/or supplements.

- To thoroughly publicize civil servants on official ethics and administrative reform; anti-bureaucracy, corruption, harassment; based on the service spirit of government to support enterprises. To publicize the process and staff who are responsible for handling dossiers, To intensify the public inspection; to resolutely handle the staff who violates the process of processing dossiers, causing troubles for enterprises. Heads of agencies or units shall be responsible for violations by officials and employees under their management.

  1. c) The Ministry of Justice shall generalize the situation of promulgation and implementation of administrative procedures at ministries, ministerial-level agencies that be attached to Government agencies, provincial / municipal People's Committees to propose solutions of administrative procedures reforms and report quarterly to the Government
  2. d) The Ministry of Home Affairs shall chair and coordinate with the concerned ministries and agencies to perform the following duties:

- To review the functions and duties of the ministries, the ministerial-level agencies, the agencies that be attached to the Government and the People's Committees of the provinces and centrally-run cities in order to report to the Government on the amendments according to the direction of clearly definition of state management functions without missing or overlapping functions and tasks. To consolidate the organizational structure, functions and duties of the State management agency for cooperative economy and cooperatives under the Ministry of Planning and Investment.

- To continue urging and guiding the ministries, ministerial-level agencies, agencies that be attached to the Government and People's Committees of the provinces and centrally-run cities to implement the overall program on State administrative reform in the stage of 2011-2020 and the administrative reform plan for stage of 2016-2020. To develop an evaluation and a discipline mechanism for handling officials and public employees who directly solve administrative procedures in all State agencies from the ward and commune level upwards.

đ) The Government Office shall chair and coordinate with concerned ministries and agencies in incorporating the following contents: "To strongly renovate the direction and administration of administrative reforms, in order to closely ensure cohesion and synchronous between the administrative reform with the establishment of e-government and the control of administrative procedures, under the direct leadership of the Government’s Prime Minister "on the Decree replacing Decree No.74 / 2012 / ND-CP dated 29 September 2012 of the Government defining the functions, tasks, powers and organizational structure of the Government Office.

  1. To create an advantage environment to support for the start up and innovative enterprises
  2. a) The Ministry of Planning and Investment shall chair and coordinate with the ministries and concerned agencies in performance of the following duties:

- To review and evaluate the implementation and effectiveness of policies to support enterprises, especially policies to support the start-up and innovative enterprises; to propose measures for speeding up the implementation or addition of functions and tasks to Development Fund of the small and medium enterprises (SME), together with the National Technology Innovation Fund and private sector funds in order to increase capital resources for the start-up enterprises, especially is the innovative and have high growth potential ones.

- To research the establishment, organization and operation of business incubator models, business support centers, the innovation and the start - up  acceleration program in the form of public-private partnership with the participation of business associations, organizations and individuals inside and outside the country.

- To build up the facilitating mechanism for supporting and encouraging individual business households that are transformed and registered under the Enterprise Law.

b) The Ministry of Science and Technology shall implement the project soon to support innovative eco-innovations after the  Prime Minister's approval.

  1. c) The Ministry of Education and Training shall chair and coordinate with Ministry of Labor, War Invalids and Social Affairs and Ho Chi Minh Communist Youth Union in formulating a scheme on assistance of students who start up their business and submit this to the Government’s Prime Minister in the first quarter 2017; to direct the tertiary education institutions to focus on involving the start-up contents into the training program.
  2. d) The Ministry of Agriculture and Rural Development shall assume and coordinate with the concerned ministries and agencies in performance of the following duties:

- To review and evaluate the implementation and propose amendments and supplements of policies for enterprises which invest in agriculture and rural areas.

- To propose mechanisms and policies to create favorable conditions for enterprises to access land and efficiently use to the agricultural land.

  1. To ensure business and equal rights to access resources and business opportunities of enterprises
  2. a) The Ministry of Planning and Investment shall chair and coordinate with the concerned ministries and agencies in performance of the following duties:

- To submit to the Government for comments on the Assistance Law for small and medium enterprises in July 2016.

- To complete the regulations on bankruptcy procedures of enterprises and facilitate the implementation of bankruptcy.

- To consolidate the Council for Promotion of SME Development along the orientation of the Prime Minister as its chairman, with the participation of the concerned ministries, branches, representatives of the business community, concerned organizations and individuals to carry out the role of coordinating and monitoring the implementation of policies and programs that support small and medium enterprises nationwide, to report to the government’s Prime Minister in 2016.

  1. b) The Ministry of Finance shall chair and coordinate with the concerned ministries and agencies in performance of the following duties:

- To make a report to the Government for submission to the National Assembly of the resolution to remove tax difficulties for enterprises immediately in 2016; to deal with delayed payment to enterprises which face to objective difficulties; to study and propose the reduction of enterprise income tax rates for small and medium enterprises; to study and propose to offset the income from the transfer of real estate with income from business activities (two-way offset), 50% reduction of personal income tax on laborers in some fields: the Information technology, the high technology, the application of high technology in the field of agriculture and the processing agricultural products ...

- To review and propose amendments to the regulations on taxes, tax administration and customs along the direction of inter-ministries among concerned ministries and agencies so as to reduce procedures, time and expenses for implementation; to study and formulate a roadmap for abandoning the form of fixed tax transferred into enterprises income tax and personal income tax for enterprises and the personal income amount paid by enterprises to laborers and to business households which have large scales in accordance with the Law on Tax Administration. At the same time, strictly comply with the provisions of the Enterprise Law applicable to large business households, which satisfy all the conditions that enterprises must declare and pay tax according to the provisions of law.

- To review and propose amendments to regulations on credit guarantee for small and medium enterprises through the Vietnam Development Bank and credit guarantee funds for small and medium enterprises in localities and submit them to the Government in the third quarter 2016.

- To implement the comprehensive and effective solutions to restructure the stock market, improve the quality and diversify securities products; to study for amendments and supplements of mechanisms in order to promote foreign indirect investment, to develop institutional investors such as investment funds, retirement funds, etc., deploy derivatives market from 2017; merge two Stock Exchanges; To develop the corporate bond market, to complete and expand the government bond market; to promote equitization, to associate with the listing and trading on the securities market; to step up the implementation of mutual fund models and submit them to the Government in the third quarter 2016.

- To coordinate branches and levels to implement resolutely the Government's Resolution No. 41 / NQ-CP dated June 9, 2015 on stepping up the fight against smuggling, trade frauds and counterfeit goods in the new situation, ensure the production environment, equality business. Quarterly, to sum up and report to the National Steering Committee for fighting smuggling, trade fraud and counterfeit in order to report to the Government

  1. c) Ministry of Industry and Trade shall chair and coordinate with the concerned ministries and agencies in performance of the following tasks:

- To deploy and implement a research, an amendment,an supplement and abolishment of current regulations on the export licensing policies, the market management, competition and supporting industries in the direction of facilitating and reducing expenditures for enterprises in accordance with international commitments; to formulate a scheme on reorganizing the domestic and cross border markets, strengthen the program on "Vietnamese prioritize to use the Vietnamese goods", then submit them to the Government in the third quarter 2016.

- To formulate the overall strategy for developing the domestic market in the stage up to 2025, with a vision till 2035, to focus on  development of the retail system, to boost the production and encouragement of the Vietnamese goods consumption, then submit this work to the Government in the first quarter 2017.

- To strengthen the provision and dissemination of information and guidelines for the implementation of commitments under international economic cooperation (ASEAN, WTO, APEC, ASEM ...) and especial economic-trade agreements. Especially is the new-generation free trade agreements to enhance the integration capacity of enterprises, to access and expand export and investment markets, especially about AEC, TPP and RCEP.

- To research and propose a mechanic, policies to attract investment for developing industrial clusters, to create the space for small and medium enterprises as well as enterprises in rural areas;

d) The Ministry of Natural Resources and Environment shall chair and coordinate with concerned ministries and agencies in performace of the following tasks:

- To study and propose for amendments of the current regulations on land in the direction of allowing industrial park enterprises and secondary enterprises to be allowed mortgage of the land use rights for bank loans and mobilize long-term capital, then submit to the Government these work  in the third quarter 2016

- To amend the regulations on land auctions in line with the provisions on selection of investors under the Bidding Law; to amend the procedures for approval of environmental impact assessment reports in accordance with the provisions of the Investment Law and submit them to the Government in the third quarter 2016.

 - To revise and amend regulations to simplify and reduce procedures of land and report to the Governments’Prime Minister in 2016.

đ) The Ministry of Science and Technology shall chair and coordinate with the concerned ministries and agencies in performance of the following duties:

- To review, amend and supplement the national standards and technical regulations and conformity assessment procedures, to standardize and create favorable conditions for commercialization of enterprises' products. To review, simplify process and procedures for the establishment of intellectual property rights; to improve efficiency of enforcement and promote the creation, exploitation and management of intellectual property of enterprises; to create favorable conditions for enterprises to access, exploit and use efficiently national main laboratories. To enhance the protection of intellectual property rights and continue to strictly handle violations.

- To propose specific measures to assist enterprises in accessing and efficiently using funds from the National Technological Renovation Fund and other State support programs for technological renewal and competition’s capacity building.

  1. e) The Ministry of Construction shall chair and coordinate with the concerned ministries and agencies in performance of the following duties:

- To amend the regulations on construction permits in order to reduce the licensing time in the spirit of the Government's Resolution No. 19/2016 / NQ-CP dated April 28, 2016 on major tasks and solutions to improve the business environment, enhance the national competitiveness in 2016-2017, the orientation is up to 2020.

 - To continue decentralization, stronger authorization in the design evaluation and the cost estimation; to amend and supplement the system of standards, basic construction standards, norms, unit prices that appropriate to the market.

 - To study and supplement mechanisms and policies to encourage and support the development of social houses and dwelling houses for workers in industrial parks.

  1. g) The Ministry of Justice shall chair and coordinate with concerned ministries and agencies in performance of the following tasks:

- To revise and supplement regulations on secured transactions, to create favorable conditions for enterprises to mortgage their properties as basis for accessing capital sources.

- To review and propose amendments and/or supplements to the provisions of law to suit the free trade agreements and relevant treaties, rationally apply flexible provisions to international commitments for maximum protection of national interests and enterprises.

- To improvie the quality of comments, appraisal, examination and handling of legal documents, to ensure the promulgation of regulations on business investment conditions and administrative procedures in accordance with their competence, really necessary, reasonable, transparent and feasible.

  1. The Ministry of Education and Training reviews and recommends amendments and supplements to the investment procedures stipulated in the Government's Decree No. 73/2012 / ND-CP dated September 26, 2012 on cooperation, foreign investment in education in line with the Law on Investment, submitted to the Government in the fourth quarter 2016.
  2. i) The Ministry of Labor, War Invalids and Social Affairs shall chair and coordinate with concerned ministries and agencies in performance the following tasks:
  3. - To review and propose amendments and supplements to the investment procedures provided in the Government's Decree No. 48/2015 / ND-CP of May 15, 2015 detailing a number of articles of the Law on Vocational Education. In line with the provisions of the Investment Law, to submit this work to the Government in the fourth quarter of 2016.

- Review and revise the regulations on foreign labor to appropriate to the market and the rights of the enterprise, simplify the procedures involved.

- To promote the training and fostering of human resources with high quality, professional and technical skills.

  1. k) The Ministry of Culture, Sports and Tourism shall study and formulate regulations on strengthening the capacity and operation of organizations protecting copyright and related rights in order to create a healthy competition environment for enterprises, to improve business ethics and protect the legal rights of authors and copyright holders in line with international practices, and report to the Government in the fourth quarter 2016.
  2. l) The State Bank of Vietnam shall assume and coordinate with concerned ministries and agencies in performance of the following tasks:
  3.  - To actively and flexibly operate the monetary policy, to maintain the market interest rate level at a reasonable level and at the same time to ensure the objective of controlling inflation, to stabilize the macro economy and contribute to create the convenient business environment for enterprises.

- To study and formulate mechanisms and policies to support the development of microfinance development models and submit them to the Government in the third quarter of 2016.

 - To continue to lead credit institutions to implement a number of measures to support enterprises, especially are small and medium enterprises to access credit capital as follows:

+ To review and renovate the lending process in the direction of simplifying loan procedures, reducing troubles for customers, to ensure the loan security and compliance with the provisions of law; to improve appraisal capacity to shorten time for loan processing, to create conditions for enterprises to access credit capital.

+ To research, develop loan programs with reasonable interest rates, encourage the diversification of banking products and services to increase accessing abilities to capital of enterprises

- To direct the State Bank's branches in provinces and cities to continue effectively implementing the program of enterprises connection with banks and the price stabilization program in their localities in order to promptly remove difficulties for enterprises.

- To implement a comprehensive roadmap to limit foreign currency credit along with the development of foreign exchange market to meet the demand on foreign currency payment for people and enterprises. To consider meeting the demand for foreign currency credit in some commodity lines in the orientation of not increasing the cost of enterprises.

  1. m) Provincial / municipal People's Committees shall urge their attached agencies to strictly observe the regulations on the land, the construction, the environment, the business, the investment registration and the related administrative procedures, to create favorable conditions for enterprises.
  2. n) The ministries, the ministerial-level agencies, the agencies that be attached to the Government, the People's Committees of the provinces and centrally-run cities and the concerned agencies:

- To review plannings for development of sectors, fields and products so as to adjust, supplement or eliminate them in line with the market and the business rights of enterprises.

- To develop and implement activities to support the business linkage by the cluster linkage, value chain; to connect the large enterprises, the foreign investment enterprises and the link orientation to the international market.

- To continue implemention of the Government's Decree No. 118/2014 / ND-CP dated December 17, 2014 on the reorganization, renewal, development, raising the efficiency of the operation of the agriculture and forestry company; to build and develop concentrated material zones, to facilitate the development of agriculture, forest and aquatic product-processing establishments.

- To strengthen the arrangement and equitization of state enterprises; to sell state capital in enterprises that the State does not need to hold, including enterprises that are doing business in an effective market economy, tocreates opportunities for private sector enterprises to develop.

- To support and create favorable conditions for social enterprise development.

- Promote small and mid-size enterprises to support through the provision of business development services: training, consulting, information, market ...

  1. To reduce business costs for enterprises.
  2. a) The Ministry of Finance shall chair and coordinate with the concerned ministries and agencies in performance of the following tasks:

- To review land legislation in the orientation of reduction of land lease, conversion costs of    the land use purpose and other costs of enterprises.

- To review and adjustment of road toll rates and BOT charges; to assess and propose reasonable adjustments to help enterprises to reduce costs, especially are the business enterprises of transport services.

 - In the fourth quarter of 2016, the Government shall consider and amend the Government's Decree No. 218/2013 / ND-CP dated December 26, 2013, detailing and guiding the implementation of the Law on Enterprise Income Tax along the direction of opening expenditures are discounted for enterprises on the capacity building activities, the business support procedures, advertisement and marketing costs, etc.

  1. b) The Ministry of Transport shall chair and coordinate with the Ministry of Finance in consideration and amendment of relevant legal documents, to ensure the publicity of prices and surcharges out of the prices of marine transport services.. To implement reasonable control measures in line with international practices of shipping lines receipts.
  2. c) The Ministry of Labor, War Invalids and Social Affairs shall  assume and coordinate with the concerned ministries and agencies in performance of the following tasks:

- To review and adjust regional minimum wage levels in line with labor productivity, economic growth, competitiveness of enterprises and minimum labor demand of laborers

- To review and propose a reasonable social insurance scheme, to harmonize the interests of laborers, enterprises and society so that enterprises can adapt and employ workers appropriately.

  1. d) The Ministry of Public Security shall chair and coordinate with the concerned ministries and agencies in reviewing and proposing amendments to the regulations on the order, procedures and conditions for the provision of fire prevention and fighting services in the direction of simplification and security, ensuring transparency, meeting all conditions required by the professional; at the same time remove the regulations, conditions to restrict competition, create conditions for all enterprises involved in providing services in this field.

đ) The Vietnam Chamber of Commerce and Industry (VCCI) conducts surveys, statistics and aggregates of official and informal expenditures to enterprises, to compares with regional and international enterprises and offers the solutions of cost reduction for enterprises.

  1. Protect the legitimate rights and interests of the enterprises.
  2. a) The Government Inspectorate shall chair and coordinate with the State Audit and concerned ministries and agencies in reviewing, amending and promulgating, or proposing competent authorities to promulgate legal documents on inspection. Especially are the specialized inspectorate, inspection and audit in the orientation of integrating, coordinating and inheriting the results of activities among agencies. Prior public plans for inspection, examination and auditing of enterprises to avoid overlapping; not inspect or examine when there are no grounds provided by law, especially in the field of tax administration.
  3. b) The Ministry of Public Security shall review, amend and supplement the regulations on social security and safety, create conditions for enterprises to operate under the business rights already prescribed by the law; strictly handle enterprises that violate the law,such as smuggling, tax evasion, trading in banned goods, counterfeit goods, trading frauds and environmental law violations, so as to ensure the equality and interests of true enterprises; do not criminalize economic and civil relations to create a healthy and safe environment for business enterprises in accordance with law.
  4. c) The Ministry of Information and Communications shall assume and coordinate with concerned ministries and agencies in performmace of the following duties:
  5. - To review and guide the press and media agencies to operate in accordance with regulations and reflect the situations; to promote the role of assisting enterprises in accessing information, building and popularizing their trademarks, honoring enterprises in accordance with law and contributing to the country's socio-economic development.

- To collect statistics, articles and press releases to detect negative behaviors and obstruct activities of enterprises and send them to the competent agencies for settlement and publicity on the Portal of the Ministry.

 d) People's Committees of provinces and cities under central authority:

- To carry out inspections and examination in accordance with the provisions of law (no more than once a year); to combine multiple inspection and inter disciplinary inspection during an inspection or examination, except for cases of inspection or extraordinary examination, when there have the signs of law violation.

- Direct the departments, branches and People's Committees at district level not to criminalize economic and civil relations.

III. Organizing implementation

  1. The Deputy Prime Minister - Head of the Steering Committee for Enterprise Development Innovation shall give general direction; Deputy Prime Ministers are assigned to take in charge of the sectors and fields for direction of the ministries, the ministerial-level agencies, the agencies belong to the Government and the People's Committees of the concerned provinces and cities directly under the Central Government in implementing this Resolution.

The Steering Committee for Enterprise Renovation and Development shall periodically report on the implementation situation; coordinate with the Ministry of Planning and Investment to annually review and propose amendments and supplements to this Resolution (if necessary).

  1. The ministers, the heads of the ministerial-level agencies, the heads of the agencies that belong to the Government and the presidents of the People's Committees of the provinces and centrally-run cities shall be according to their assigned functions and tasks:
  2. a) To formulate a program of action for the implementation of this Resolution and report it to the Prime Minister before July 1, 2016.
  3. b) To direct, regularly inspect and supervise, to ensure the timely performance of the objectives, the tasks, the solutions and the report regime stated in this Resolution.
  4. c) To promptly synthesize petitions, difficulties and problems of enterprises within the sectors, fields or geographical areas assigned to them for management or transfer them to the competent agencies for settlement.
  5. d) To strictly handle cases where officials and public employees cause difficulties and harass enterprises according to the provisions of law.
  6. In the third quarter 2016, the Chairmen of the People's Committees of the provinces and cities directly under the Central Government sign a commitment with the Vietnam Chamber of Commerce and Industry, witnessed by the Steering Committee for Innovation and Development of enterprises on creating favorable business environment for enterprises.
  7. Enterprises:
  8. a) To promote national pride, business ethics, to respect the law, to develop the  corporate culture and integrity in business, to perform the good corporate social responsibility, to participate in the poverty reduction program to hunger eradication and poverty alleviation, to protect the environment and contribute to ensure the political security and thesocial and safety order.
  9. c) To strengthen solutions for building harmonious, stable and progressive labor relations in enterprises.
  10. Vietnam Chamber of Commerce and Industry and business associations and industry associations.
  11. a) To develop the specific,feasible programs and measures to further improve the quality of activities, to well perform the role of social organizations and occupations of the business community, the businessmen and employers in Vietnam.
  12. b) To coordinate with the Ministry of Planning and Investment, ministries, sectors, localities and agencies in developing and implementing programs and projects to support the capacity building of competitiveness of enterprises and the capacity building of the program for business associations.
  13. c) Vietnam Chamber of Commerce and Industry:

- To generalize the recommendations of difficulties and problems of enterprises and transfer them to the State management agencies for handling and settlement; to monthly report to the the Government’s Prime Minister, to quarterly report to the Government on the situation and results of implementation; published on the website of Vietnam Chamber of Commerce and Industry.

- To generalize the situation of realizing the commitments signed between the People's Committees of the provinces and centrally-run cities and the Vietnam Chamber of Commerce and Industry, quarterly and publicly report them to the Prime Minister on the electronic information. page oft he Chamber of Commerce and Industry of Vietnam.

  1. To recommend the National Assembly and People's Councils at all levels to regularly supervise the activities of judicial agencies in order to prevent acts of criminalizing economic and civil relations.
  2. To request the Vietnam Fatherland Front to mobilize, guide and honor the enterprises in accordance with law, to contribute to the development of the country; to participate in supervising, evaluating and proposing solutions to support and develop Vietnamese enterprises.
  3. To recommend Vietnam General Confederation of Labor to gather and develop a contingent of qualified workers with a sense of responsibility and cooperation for the development of enterprises; to propose solutions to protect the legitimate rights and interests of workers; to participate in supervising, evaluating and proposing solutions to support and develop Vietnamese enterprises.
  4. The Ministry of Information and Communications promotes the dissemination and propagation of this Resolution and the policies on enterprises development.
  5. The Ministry of Planning and Investment shall chair:

- To coordinate with the Vietnam Chamber of Commerce and Industry to develop and publish a set of indicators for assessing the level of enterprise development of ministries, ministerial-level agencies, agencies belong to the Government, People's Committees of provinces and cities. Centrally-run cities; to annually survey, evaluate, rank and publicize results on the Ministry's electronic portal.

- To coordinate with the Steering Committee for Enterprise Renovation and Development and the concerned ministries and agencies to urge, inspect and supervise the implementation of the Resolution; to quarterly report to the Government on the implementation situation.
