Performing the tasks assigned by the Government’s Prime Minister in Resolution 35 / NQ-CP dated May 16, 2016 of the Government on business support and development until 2020, the Vietnam Chamber of Commerce and Industry (VCCI) respectfully reports on the performance of assigned tasks in November 2020, specifically as follows:
I. THE RESULTS OF THE MINISTRIES, BRANCHES AND LOCALITIES’ AGGREGRATING AND RESOLVING RECOMMENDATIONS OF BUSINESSES
1. The implementation of gatheringbusinesses' recommendation
In November 2020, VCCI gathered, classified and sent 16 new recommendations of businesses and business associations to ministries, branches and localities. In which, the Ministry of Finance is still the agency receiving the most recommendations (05 recommendations); The rest are the Ministries: Public Security, National Defense, Foreign Affairs, Industry and Trade, Natural Resources and Environment, Labor, Invalids and Social Affairs and localities: Hanoi and Ho Chi Minh Cities, Dong Nai, and Tra Vinh Provinces. The basic contents of the recommendations in the month mainly propose to guide the implementation of law provisions. In addition, there are also a number of recommendations on law development and some specific cases of the enterprise such as:
- Proposed to amend the Draft Circular promulgating the list of industries and occupations using trained workers, such as:
+ Clarified the definition of professions and training positions according to the Government's regulations.
+ Specified the occupations and job positions to be trained according to the Government's regulations.
+ Allowed enterprises to facilitate self-training and self-grant of training certificates for employees by amending the current regulations such as not requiring vocational trainer in enterprises to have certificates, pedagogic…
- Guided the receipt of transferred shares, implementing legal procedures under the Enterprise Law to create conditions for enterprises to invest and come into operation.
- Recommended to reconsider the classification of the item "Alaska Deep Sea Fish oil Omega 3,6,9" in accordance with international practice.
- Proposed to consider a plan to support domestic car manufacturers: Currently the original car buyer must pay 100% SCT, instead of collecting this fee, the Government can create favorable conditions for annual installment consumption, payment at the same time to bring the vehicle for inspection, and annual road tax payment. The installment payment period can be 10-20 years, depending on the state agencies. In this way, the initial amount the car buyer has to pay is greatly reduced, so the consumer needs will increase, while the state will not lose revenue, even more. In particular, this month, there was a recommendation of Hoang Thanh Joint Stock Company that issued a recommendation from June 2020 to the Ministry of National Defense, City People's Committee. Ho Chi Minh City guided administrative procedures for issuing business registration certificates to partners who lease the premises of the Company, although the Government Office issued official dispatch No. 4424 / VPCP-ĐMDN dated June 3, 2020 that sent to the Ministry of Defense, but so far it has not been resolved. In addition, the Delta Construction Group Co., Ltd. has continuously sent an official dispatch to the Government Office and related agencies to request the Voice of Vietnam to pay outstanding debts for businesses from 2013 to present with the amount of over VND 60 billion. Details of the data and content of new recommendations are in Appendix 1, Appendix 2 attached to the report.
2. The situation of handling recommendations of ministries, branches and localities
2.1. Answering and resolving recommendations: In November 2020, VCCI received 12 written responses to business proposals of ministries, branches and localities. These documents were fully posted by VCCI on the website of VCCI as specified in Resolution 35 (Details in Appendix 3 attached to the report). In general, responding to recommendations of ministries, branches and localities this month with a spirit of urgency and decency. Especially in this month, there were 4 recommendations of enterprises sent from the beginning of the month, but by the end of the month, they have been answered and settled by the Ministries: Finance, Foreign Affairs, Public Security, the rest were from the previous months. The village were answered by ministries, branches and localities. Responses to recommendations mostly related to guiding the implementation of the provisions of the law, offering solutions to support and remove difficulties to create conditions for businesses to do business. The Ministry of Finance is the agency that responds the most to recommendations (07 recommendations), the rest are other ministries, branches and localities.
2.2. The recommendations were not resolved According to VCCI's monitoring, from November 1, 2020 to November 30, 2020, there were 07 recommendations of businesses and business associations that were not answered on time by ministries, branches and localities. The reason for the delay in responding to proposals of businesses and business associations was due to recommendations related to many ministries, branches or units within the Ministry, it took time to discuss and reach agreement before responding to it. Especially in the locality, it is necessary to go through the Departments and branches to study and advise the Provincial People's Committee to solve. Details of unanswered recommendations and responsibilities for handling by ministries, agencies and localities this month were included in Appendix 4 attached to the report.
II. IMPLEMENTATION OF RESOLUTION 35/NQ-CP OF THE VCCI
In November 2020, VCCI implemented the following tasks:
- Implementing activities to contribute to administrative reform; creating a favorable environment to support businesses.
- - VCCI commented on draft legal documents: Law on Environmental Protection (amended); Decree amending and supplementing a number of articles of Decree 34/2016 / ND-CP detailing a number of articles and measures to implement the Law on the Promulgation of Legal Documents; The Decree details a number of articles of the Law on Investment under the public-private partnership mode; Decree on derivative securities and derivative securities market; Decree amending and supplementing a number of articles of Decree 34/2016 / ND-CP detailing a number of articles and measures to implement the Law on the Promulgation of Legal Documents; Decree amending and supplementing a number of articles of Decree No. 06/2016 / ND-CP on management, provision and use of radio and television services; Circular amending and supplementing a number of contents in Circular 15/2019 / TT-BYT regulating the bidding for drug purchase at public medical establishments; Circular amending Circular 38/2015 / TT-BTC on customs procedures; customs inspection and supervision; export tax, import tax and tax administration for exported and imported goods ... - - Organized a dialogue conference on tax and customs policies and procedures in 2020 in the North and the South, attracting over 1000 delegates of enterprises, business associations, ministries and localities above nationwide. The conference focused on two main contents: general information on changes in policies and new administrative procedures in the fields of tax and customs; At the same time, representatives of the leaders of the tax and customs industry had dialogues and answers difficulties and problems for businesses in the process of implementing tax and customs policies and received comments to build documents, Legal version from the business side. Also at the conference, representatives of the General Department of Customs, the General Department of Taxation introduced a number of new points, new legal policies related to the reform of tax procedures and customs this year. In the role of connection and coordination, VCCI will gather comments from associations to report to the Government’s Prime Minister once a month and every 3 months to the Government on the most urgent issues, related to the business survival, the purpose is to convey to the competent State agencies in order to quickly get answers and solutions in the spirit of understanding and sharing.

- Collaborated with the Vietnam General Confederation of Labor and Samsung Vietnam to organize the 2020 Multilateral Forum with the theme "Responsible response in crisis management: Sharing experiences from the COVID-19 pandemic". At the Forum, delegates emphasized the unprecedented challenge from the Covid-19 pandemic highlighting ever more importance the values of "co-prosperity" and "responding to the crisis in a meaningful way of social responsibility". Many businesses, during the Covid storm, still tried to maintain jobs for their employees, adapt flexibly by applying technology, shifting production to high-demand products ... Speaking at the event, VCCI Chairman said that, in the difficult conditions of the state budget, requiring a package of direct cash support that is large enough, the business community needs a support package by promoting institutional reform and innovation. Business environment, simplifying administrative procedures to facilitate production activities, thereby contributing to ensuring social security, at the same time, policies should be issued in a timely manner, ensuring the fair
- Coordinated with the Vietnam Association of Road Traffic Construction Investors (VARSI) to organize a meeting of the National Assembly delegations to exchange information about investment projects of road traffic in Vietnam according to PPP form. The meeting was attended by 9 delegations from Cao Bang, Phu Yen, Binh Dinh, Quang Tri, Quang Binh, Ha Tinh, Lang Son, Ca Mau, Thua Thien Hue Provinces, representatives of the Ministry of Transport, Planning & Investment, State Bank of Vietnam, Vietinbank. As a co-moderator of the meeting, the VCCI’s Chairman Vu Tien Loc said that from the reality of the project implementation, in the investment sector in the form of public-private partnerships, there were still many problems that need to be addressed, settlement, including: Ensuring equality between State agencies and investors; changing mechanisms and policies affecting the project's financial plans; the risk sharing mechanism between the State and investors is not fair. The VCCI recommended: (i) The State needs to resolve the old commitments and shortcomings of the implemented projects and at the same time perfect the equal legal system, in line with reality, that is to deal with to finish the existing problems of implemented PPP projects, in which focusing on strictly implementing the commitments of state agencies, ensuring the legitimate rights of investors to avoid consequences and creating confidence for investors, credit institutions participating in new projects. (ii) Developed decrees and circulars guiding the PPP Law, which clarified regulations on risk sharing for on-going / on-going projects to deal with the problems of affected projects. The change of legal policy or the state agency does not comply with the commitment of the contract.
2. Implementing trade and investment promotion activities and programs and projects to support competitiveness improvement of enterprises and business associations:
- This month, the VCCI chaired and coordinated with partners to organize a series of activities on the sidelines of ASEAN Summit Week 2020, including: ASEAN Business and Investment Summit (ASEAN BIS) 2020: The conference was attended by the Government’s Prime Minister Nguyen Xuan Phuc, ASEAN leaders and partners and many businesses in the region. With the theme "Digital ASEAN: Sustainable and Inclusive", ASEAN BIS 2020 is the bridge between leaders, policymakers and international organizations and leading businesses in the region to discuss, share experiences and best practices to open up opportunities for cooperation and development. At the meeting, the Government’s Prime Minister affirmed that Vietnam committed to cooperate with ASEAN member states and ASEAN's partner countries to continue to have practical support programs for businesses in the region, especially in the digital transformation areas; environment, society and governance (ESG); technology and employment futures in the region; sustainable and inclusive development; work together to achieve a common goal of placing people and businesses at the center of development; at the same time, toke advantage of new opportunities due to the movement of supply chains, global investment flows towards the ASEAN region. In the framework of ASEAN BIS 2020, 58 best enterprises in ASEAN region were honored with 10 categories of ASEAN Business Awards 2020 (ASEAN Business Awards - ABA). ABA is the official award of the year ASEAN organized annually by the ASEAN Business Advisory Council (ASEAN BAC) since 2007.
Vietnam Business Summit 2020 (VBS 2020): This year's conference was honored to welcome Member of the Politburo, Standing Deputy Prime Minister Truong Hoa Binh to attend and direct the Conference, together more than 1500 local and international delegates participated directly and online on a global scale. With the theme "Digital Vietnam: Proactively adapting to sustainable development", this year's conference focused on discussing new opportunities for investors in the Vietnamese market in the context of the industrial revolution 4.0. And the effects of the Covid-19 pandemic. Vietnam as well as other economies are significantly affected by the pandemic and the new investment trend of the region. Therefore, Vietnam needs to overcome the challenges and seize opportunities to become a stop for the new wave of investment in the region, especially in two key areas: smart logistics (logistics ) and high-tech agriculture. ASEAN Women Entrepreneurs Summit 2020: The conference attracted the participation of more than 500 delegates who are representatives from all departments, ministries, branches of the Vietnamese government, ASEAN Secretariat, ASEAN Women Committee, representatives embassies, international organizations, experts, women's business associations and women entrepreneurs from ASEAN member countries. Vice President Dang Thi Ngoc Thinh attended and delivered an important speech at the Conference, highly appreciated the significance and importance of the event, contributing to enhancing the status and voice of the business community. Vietnamese women and ASEAN female entrepreneurs, contributing to the overall success of ASEAN 2020. The event was also honored to receive a welcome message from ASEAN Secretary General Lim Jock Hoi. With the theme "Changing for a stronger and more resilient female business community", the conference had 4 sessions to discuss solutions to support women businesses to actively adapt during and after the Covid-19 pandemic; promoted digital transformation and comprehensive recovery for women-owned businesses; Made smart investments through a gender lens and promote effective partnerships through networks.
- Organized Economic Forum 2021: The forum for economic recovery and development. The forum focused on analyzing and forecasting economic trends in 2021, at the same time, giving recommendations to solve arising difficulties and problems, helping businesses to plan policies and strategies in business of the year 2021 and the following years. Assessing new trends and directions after the COVID-19 pandemic, experts attending the forum said that there were 6 issues to note: the uneven impact of the epidemic, new opportunities from Digital platform, opportunities from energy infrastructure development, investment opportunities in the healthcare industry, opportunities from global supply chain rearrangement, opportunities from export production utilizing EVFTA and RCEP. Internet economy is a bright spot in the dark pandemic picture that Vietnam has recorded an impressive 5% growth in ASEAN region. In which, there is a series of strong growth products related to e-commerce such as apparel, electronics and food. Areas such as lending, educational services, entertainment, and digital content also increased strongly. In the new context, businesses need to restructure on the basis of: recognizing trends; taking advantage of; creating endless; wise connection; risk management
- Organized a number of seminars: Coordinated with the Advisory Council for Educational Science and Environment (Central Committee of the Vietnam Fatherland Front) to organize the Forum "Resolution 55-NQ / TW and other Vietnam Renewable Energy Development Solutions "and Awarding Certificates to Projects in the Selection Program" Typical Renewable Energy Projects in Vietnam 2020 ", Conference on " Strengthening Supply Chain Connection of Power Industry from Vietnam " in Hanoi; Online Export Forum for Food and Beverage Industry 2020, in collaboration with Tokyo SME Support Center to organize a Vietnam - Japan Online Trade Exchange on equipment and the environment, the seminar "Trade defense - A tool to protect domestic industry interests in the context of integration" in Ho Chi Minh City; Workshop on "Digital transformation in organizational development and quality management of business services" in Hai Phong; Workshop "Connecting technology supply - demand in the agriculture and fisheries sector for SMEs" in Nha Trang ...
