The 2024 Land Law - Many provisions closely related to businesses

The Land Law (amended) is a legal document that has a significant impact on the business community and the investment environment of our country. Meeting the needs of the business community, on April 12, 2024, the VCCI chaired a seminar titled "The 2024 Land Law: Important provisions that businesses need to know" in Ho Chi Minh City, attracting 120 participating businesses.

In his opening speech at the conference, sharing the importance of the 2024 Land Law, Vice Chairman of the Vietnam Chamber of Commerce and Industry (VCCI) Vo Tan Thanh stated that the 2024 Land Law was meticulously crafted by the entire political system of the National Assembly and was passed on January 18, 2024, to take effect from January 1, 2025. The Land Law is one of the major and crucial laws that deeply impact the economic and social life, particularly affecting the investment environment of our country.

Mr. Vo Tan Thanh emphasized that alongside the 2024 Land Law, the National Assembly has also passed amended and supplemented laws regarding real estate business and housing. These are laws that greatly affect businesses because the real estate market is especially important in every economy. These laws were enacted to resolve issues that were not yet harmonized between these two laws and the investment law, facilitating investment resources and smoother project implementation.

At the conference, Mr. Nguyen Duc Hieu - Standing member of the Economic Committee of the National Assembly, along with policy planners, exchanged views and provided explanations on important amendments of the 2024 Land Law.

Many hot topics affecting businesses such as: land planning, land use planning; land recovery, compensation, support, resettlement; land allocation, land leasing, land use purpose change permits; land finance, land prices; land registration; administrative procedure reform in land-related fields...

Closely related laws such as the Real Estate Business Law, the Housing Law, the Construction Law... were also discussed at the conference. Mr. Hieu stated that the spirit of the 2024 Land Law focuses on two points: Protecting the rights and interests of the people, land users, and institutional reform.

At the conference, the presentation by Ms. Doan Thi Thanh My - Head of Department, Land Department, Ministry of Natural Resources and Environment, regarding the new points throughout the 16 chapters of the 2024 Land Law, particularly attracted the attention of the business community.

 

Mr. Vu Sy Kien - Deputy Director of the Department of Planning and Land Resource Development, Ministry of Natural Resources and Environment

Following that, Mr. Vu Sy Kien - Deputy Director of the Department of Planning and Land Resource Development, Ministry of Natural Resources and Environment, introduced the provisions of the 2024 Land Law from the perspective of land approach to implement projects of investors and policies regarding land recovery, land allocation, BOT (Build-Operate-Transfer), BT (Build-Transfer), TDC (Transfer of Development Rights), land finance, corresponding land prices.

In her presentation, Ms. Tong Thi Hanh, Head of the Legal Affairs Department, Ministry of Construction, focused on sharing the policies of the Land Law related to the Real Estate Business Law, the Housing Law, the Construction Law, and the Urban Planning Law.

 

Mr. Dau Anh Tuan, Deputy Secretary-General cum Head of the Legal Affairs Committee of VCCI, coordinated the Q&A session with the speakers.

Alongside opinions from representatives of specialized agencies, experts, and speakers, the seminar also listened to the opinions of businesses on related issues and hoped that policies would be reflected in future guidance documents for the enforcement of the law.
