New regulation removes obstacles for issuing construction professional certificates

Government Decree No. 35/2023/NĐ-CP dated June 20, 2023, stipulates appropriate specialization criteria for granting professional certificates in the field of construction activities related to the design of mechanical and electrical works. This no longer excludes projects involving power lines and transformer stations.

Mr. Duong Minh Hoang and many others in Da Nang City hold professional certificates in fields such as electrical design, architectural design, and engineering valuation. Although their certificates have expired, they have encountered difficulties in renewing their licenses.

Mr. Hoang approached both the Ministry of Construction and the Ministry of Industry and Trade for guidance, but both responded that the existing regulations must be strictly followed. However, he remains uncertain about which authority to work with to undergo reexamination for license renewal, or whether a professional certificate is required in this field (which is particularly crucial for those engaged in consulting for power lines and transformer stations).

This issue has posed significant challenges for citizens seeking to renew their professional licenses, leading to missed job opportunities and potential unemployment during new project bidding.

Mr. Hoang recommended that relevant authorities take action to address this concern and help alleviate administrative burdens for citizens.

The Ministry of Construction responded to this matter as follows:

The examination for the issuance of professional certificates in construction activities is regularly conducted by the Management Department for Construction Operations. They provide notifications to individuals who meet the examination requirements, specifying the exact timing and location of the examination.

The Government issued Decree No. 35/2023/NĐ-CP dated June 20, 2023, amending and supplementing certain provisions of decrees within the realm of state management by the Ministry of Construction. Specifically, in Article 20 Section 12, amendments and supplements were made to Point b, Section 3, Article 67 of Decree No. 15/2021/NĐ-CP dated March 3, 2021, regarding appropriate specialization criteria for granting professional certificates in construction activities. The revision states:

"b) Design of mechanical and electrical works: Expertise trained in relevant technical fields related to electrical, mechanical systems, ventilation, and heat exchange;"

In Section 3.3 of Appendix VI of Decree No. 15/2021/NĐ-CP dated March 3, 2021, the Government outlines:

"Grade I: Authorized for leading architectural design, holding design oversight and evaluation responsibilities for mechanical and electrical aspects of projects at all levels;

Grade II: Authorized for leading architectural design, holding design oversight and evaluation responsibilities for mechanical and electrical aspects of projects from Level II downwards;

Grade III: Authorized for leading architectural design, holding design oversight and evaluation responsibilities for mechanical and electrical aspects of projects from Level III, Level IV."

Thus, Government Decree No. 35/2023/NĐ-CP dated June 20, 2023, specifies the appropriate specialization criteria for granting professional certificates in construction activities related to the design of mechanical and electrical works, with no exceptions for projects involving power lines and transformer stations.
