The company has repeatedly submitted complaints and settlement requests to local authorities with the following main information:
- The company has proposed to build a petrol station with a total land area of 2148.9m2.
- According to the planning of the petroleum trading network in Lang Son Province in the period of 2011-2020, orientation to 2025 (according to Decision No. 714 / QD-UBND dated June 13, 2012 of Lang Son People's Committee) This table is allowed to build a new gasoline station type 3, with an area of 1000 m2.
- However, People's Committee of Lang Son Province issued an Oficial Letter No. February 21, 2017 to the business that the entire area of 2,148.9 m2, including 1,645.8 m2, is the soil plot, water canal and the land for protection and maintenance of the road safety corridors managed by the State shall not be permitted to construct. The business that carried out the leveling was contrary to regulations. Conclusion: The land in Pac Can, Na Cauom, Tan Lang Commune, which complainted to the People's Committee on the construction of petrol station is not eligible to build a petrol station under the master plan.
- Previously, the People's Committee of Van Lang District also had many documents to reply to the company:
- The site that proposed for construction is mostly located on river and stream lands managed by the State as regulated, the transfer of land in contravention of regulations, threat to the environment, the area of agricultural land and houses of people... when flooded.
- The site is located within the road safety corridor and within the scope of the avoidance line of National Road No 4A project running through Na Ham and Bo Cung Pass, which the People's Committee of the province is proposing to the competent authorities for approval.
- The proposed location is not in line with the province's petroleum trading network (about 300m far from the planned site).
- The company did not agree with some examples of other individuals and businesses violated (Thien Duong Restaurant built without license, Nguyen Ba Thanh Private Company leveled more than 3000 m2 of fields, made a change in flow of sewage that is smaller than the flow of whole residential area. In order to reduce the flow of sewage from the whole residential area, Mr. Ha Van Sang leveled a field for production and business, and Huyen Thang Co., Ltd. was allowed to build a petrol station. The current petrol station is 1km away from the old station ...), but the submit of permission on the construction of the business was not allowed. The related official Letter requested the company to find another location.
The company would like to request the competent authorities:
- To consider re-checking the location of the site (because the proposed location is 250m far from the center of the T-junction that is reasonable, the project of avoiding national highway 4A has not yet been approved, has not yet got land recovery decision ...);
To request being granted the land use rights for the above land area to complete the initial appraisal procedures
(We had a request to extract the map to complete the application procedures for the grant, but leaders haven’t been paid attention and considered creating conditions for businesses)
