In his opening remarks, VCCI Vice Chairman Hoang Quang Phong emphasized the important role of the Land Law in the legal system related to investment, business and socio-economic development. He said that through practical implementation, some regulations have revealed limitations such as high land prices causing great pressure on investors, as well as difficulties in choosing the form of land lease and land allocation to investors. The revised draft has proposed many new points such as removing the specific land price mechanism, applying the land price adjustment coefficient, allowing land users to flexibly choose the form of land rental payment to facilitate businesses, while adjusting in accordance with the two-level local government model and Party resolutions.
Mr. Hoang Quang Phong also expressed his appreciation for the close coordination between the Ministry and VCCI in organizing the workshop, and affirmed that this was an opportunity for delegates to give frank comments to perfect the draft law, towards a transparent and stable policy, both creating favorable conditions for production and business and ensuring effective management of national land resources.
At the discussion session, opinions from the business community and industry associations were listened to and directly explained by the drafting committee.
According to Mr. Nguyen Huu Thap, Chairman of the Tuyen Quang Provincial Business Association, many practical difficulties were shared. He pointed out that the current planning and land use plan are not suitable for the two-level government model when the commune level still maintains the annual land use plan as a formality, causing overlap and waste. In addition, he emphasized the lack of synchronization between the Land Law and related laws such as the Law on Auction, the Law on Bidding and the Law on Urban Planning, causing difficulties in project implementation. He also proposed to abolish the commune-level land use plan, maintain only medium-term and long-term planning, and assign the Provincial People's Committee to decide on adjusting annual targets, while simplifying procedures for strategic projects by exempting land use rights auctions and allowing the recovery of the remaining area when investors have agreed on most of the area.

Meanwhile, Lawyer Nguyen Van Dinh, a legal expert in the field of land and real estate, focused on analyzing important amendments to land price policies and land finance. He noted that the draft law has eliminated the market principle in the land valuation method, instead emphasizing the principle of conformity with state management requirements and local practices. This is to help the State control land prices in the primary market to ensure stability, avoiding the situation of land prices being "floating", causing difficulties for businesses and people. In addition, the draft abolishes the concept of "specific land price" and replaces it with "land price adjustment coefficient", and stipulates a periodic land price list every 5 years instead of annually. Lawyer Dinh assessed that these are solutions to "ease people's strength", reducing financial pressure on businesses in the context of high land use costs. The workshop “Comments on the Draft Law amending and supplementing a number of articles of the Land Law” is an important step to perfect land policies, towards a synchronous, flexible and effective legal system, meeting the requirements of socio-economic development in the new period. The active participation of the business community and experts will contribute to creating practical regulations, promoting a favorable and sustainable investment and business environment.
