According to Clause 2, Article 9 of Decree No. 178/2025/ND-CP dated July 1, 2025, detailing some provisions of the Law on Urban and Rural Planning: "For land plots meeting the requirements in Clauses 3 and 5, Article 10 of this Decree, the detailed plan shall be prepared using a simplified process (referred to as the 'master plan' process), without the need to prepare and approve the planning task and without organizing the appraisal and approval of the plan." However, the Department of Construction stipulates that "the preparation of the master plan should not be carried out in the form of a master plan, but must be carried out according to the regulations on the preparation of detailed urban and rural plans." Mr. Pham Van Thuan (Hung Yen) asks whether this is within the correct authority. The Ministry of Construction responds to this issue as follows: According to Decree No. 178/2025/ND-CP dated July 1, 2025, of the Government detailing some provisions of the Law on Urban and Rural Planning, the cases for preparing a master plan are regulated as follows: Clause 2, Article 9 of the Decree stipulates: "2. For land parcels that meet the provisions of Clauses 3 and 5, Article 10 of this Decree, the detailed plan shall be prepared according to a simplified process (referred to as the process for preparing a "master plan"), without the need to prepare and approve the planning task and without organizing the appraisal and approval of the plan." Clause 3 and Clause 5 of Article 10 of the Decree stipulate: "3. Land plots for investment and construction projects that simultaneously meet the following conditions shall have their master plans prepared and approved: a) Having a land use scale of less than 2 hectares for investment projects in apartment buildings or apartment complexes; or having a land use scale of less than 10 hectares for investment projects in factories, enterprises, industrial production facilities, or non-linear technical infrastructure works as determined by the general plan or specialized technical infrastructure plan or provincial plan or approved technical or specialized plan; or having a land use scale of less than 5 hectares for other cases; b) Within an area with an approved zoning plan or within an area with an approved general plan in cases where the preparation of a zoning plan is not required; c) The investment and construction are carried out by a single investor or The state agency assigned to carry out the preparation of the overall site plan. ... 5. For defense and security projects requiring state secrecy, the application of the overall site plan preparation shall be in accordance with the regulations and guidelines of the agency, organization, or individual assigned to manage and implement the project requiring state secrecy. Regulations on cases for preparing detailed urban and rural plans shall be implemented according to Article 6 of the Law on Urban and Rural Planning 2024; Clause 1, Article 9 of Decree No. 178/2025/ND-CP.
