Mr. Vo Viet Anh (Ho Chi Minh City) asks: If the Management Board's term has expired (as stated in the decision) and its activities have ceased, during the period from the request for recognition of a new Management Board until the competent authority decides to recognize the new Management Board, who is responsible for handling the Management Board's powers and responsibilities? Will the expiration of the Management Board's term (cessation of activities due to the expiration of its term) be governed by Clause 5, Article 148 of the Housing Law or Clause 5, Article 26 of Circular No. 05/2024/TT-BXD dated July 31, 2024? The Ministry of Construction responded to this issue as follows: Clause 5, Article 148 of the 2023 Housing Law stipulates: "5. In the event that the condominium management board ceases operation and the new condominium management board has not yet been recognized, the People's Committee of the commune where the condominium is located shall assume the responsibilities of the condominium management board until the new condominium management board is recognized." Clause 5, Article 26 of the Regulations on the Management and Use of Apartment Buildings, issued together with Circular No. 05/2024/TT-BXD dated July 31, 2024, by the Minister of Construction, stipulates the dismissal or removal of a member of the Management Board or the entire Management Board: "5. When proposing the election of a new Management Board member to replace the previous one, the recognized Management Board shall continue to operate according to its operating regulations until the competent authority recognizes the new Management Board; in the case of re-election of the Management Board due to dismissal or removal, the new Management Board shall be elected by the Apartment Building Conference in coordination with the People's Committee of the commune where the apartment building is located and the management and operation unit to exercise the powers and responsibilities of the Management Board until the competent authority recognizes the new Management Board." The provisions in Clause 5, Article 26 of the Regulations only apply to cases of dismissal or removal of a member of the Board of Directors or the entire Board of Directors as specifically stipulated in Clauses 1 and 2, Article 6.
