On October 24, 2022, Mr. Tam got a job and signed an employment contract, and the company paid social insurance for him in November 2022. Mr. Tam asked if he would have to repay the last month's unemployment benefits he received.

On this matter, the Vietnam Social Security responded as follows:

According to the provisions at point b, clause 3, Article 53 of the Labor Code, an unemployed worker's unemployment benefits will be terminated when they find employment.

According to the provisions in clause 4, Article 21 of Decree No. 28/2015/ND-CP, if an unemployed worker's unemployment benefits are terminated on any day of the month in which they are receiving unemployment benefits, they will still receive unemployment benefits for the entire month.

Since the person in question did not provide complete information, such as their social insurance number, ID card number, full name, date of birth, contact phone number, etc., the Vietnam Social Security does not have the basis to look up their information in the system and provide a specific answer. They suggested that the person should contact the job service center where they received unemployment benefits for support and clarification.
