(Chinhphu.vn) – Ms. Nguyen Hong Dao had a land plot, then she bought an adjacent plot, was separated from the plot and granted a land use right certificate. Ms. Dao would like to ask, in order to carry out matching 2 above land plots, what procedure does she need to carry out the two land plots? Which agencies does she submit to? And how long does it take for submitting?

On May 19, 2014, the Ministry of Natural Resources and Environment issued a Circular No. 25/2014 / TT-BTNMT regulating cadastral maps. According to the provisions in Item a, Point 2.3, Clause 2, Article 8 of this Circular,  then the land plot shall be determined according to the scope of management and use by a land user or a group of land users or a person assigned by the State to manage land; has the same purpose of use in accordance with the law on land.

Accordingly, in the case of two adjacent land plots with the same use purpose of a land user, when there is a need for management, the land user will be combined into one parcel.

The sequence and the procedures for land lot matching shall comply with the provisions of Clause 1, Clause 2, Article 75 of the Decree No. 43/2014 / ND-CP.According to guidance on Clause 11, Article 9 of the Circular No. 24/2014 / TT-BTNMT, the land user shall submit to the Land Registration Office a set of dossier of applying for land consolidation, including:

- An application for separation of plots or plots according to the Form No. 11 / DK;

- Original Certificate issued.

The Land Registration Office is responsible for performing the following tasks:

- Cadastral measurements to combine land plots;

- Prepare documents to submit to the competent authority for issuance of land use right certificates, ownership of houses and other land-attached assets to land users for new land plots;

- Adjust and update changes in cadastral and land database; hand over certificates of land use rights, ownership of houses and other assets attached to land to the grantees or send them to the commune-level People's Committees to hand over the dossiers at the commune level

The time for carrying out land procedures is specified by the provincial People's Committee where the land is located. The time for carrying out the land-use-right procedures is usually no more than 30 working days after receiving a complete and valid dossier.
