Mr. Quang asked, if his unit hires another unit (contract) to carry out the measurement, will the funds paid under the contract later be recovered?
The Ministry of Natural Resources and Environment responded to this issue as follows:
According to the provisions of Article 11 and Clause 2, Article 15 of Circular No. 34/2014/TT-BTNMT dated June 30, 2014 of the Ministry of Natural Resources and Environment regulations on construction, management and exploitation of land information systems, for places where cadastral maps are available in localities, organizations and individuals wishing to extract cadastral maps in service of economic and social development purposes, in accordance with the provisions of law, will submit a request form or send a written request to the land data-providing agencies, namely the Land Registration Office or the commune-level People's Committee (for localities where a land database has not been built) according to the form to Extracted from the cadastral map for use.
According to the provisions of Circular No. 25/2014/TT-BTNMT dated May 19, 2014 of the Ministry of Natural Resources and Environment on cadastral maps,
cadastral measurements are only made in places where there is no cadastral map to serve the requirements of land management.
In case the unit wishes to hire another unit to perform cadastral mapping measurements to serve its own needs, the contract shall comply with commercial and civil laws; the organizational process shall comply with regulations on measurement and correction of cadastral maps.
However, it should be noted: the correction of cadastral records is the responsibility of the Land Registration Office and the cadastral map must be certified by the Department of Natural Resources and Environment to be eligible for use.
