After the administrative boundary merger and the implementation of a two-tiered government system, Mr. Khanh contacted the Land Registration Office to process the renewal of his land use certificate. He was instructed to have the land use purpose changed to rural residential land. Mr. Khanh asked if this is correct. The Ministry of Agriculture and Environment responds to this question as follows: The issue you raised falls under the jurisdiction and responsibility of the local authorities (commune and provincial levels) and must be addressed on a case-by-case basis. However, in principle, in cases where a land plot was granted a Certificate of Land Use Rights before July 1, 2025, and the reorganization of commune-level administrative units results in a change in land type from urban to rural or vice versa, the land administration agency is not allowed to require the land user to update the land type information on the issued Certificate. Instead, this update should be done simultaneously when the land user completes the administrative procedure or based on the land user's needs. If the land user wishes to update the land type on the issued Certificate of Land Use Rights, the change in land type should be confirmed according to the land user's request. In cases where land and property registration changes are carried out and a new Certificate of Land Use Rights is issued according to regulations, the land type on the Certificate shall be indicated as residential land as stipulated in Clause 1, Article 5 of Decree No. 102/2024/NĐ-CP.
