Sending comments to the 5 th Session, National Assembly XIV, voters of Hai Duong Province requested competent agencies to specify the subjects who are experts in Decision No. 57/2013 / QD-TTg on October 14, 2013 and Decision No. 62/2015 / QD-TTg dated December 4, 2015 of the Government’s Prime Minister to make Hai Duong Province have grounds for implementation.
According to the opinion of the voters, currently retired officials in Hai Duong Province had time nominated to help Laos and Cambodia, but have not been entitled to a lump-sum allowance because the records are officials who come to help Laos, not be recorded as expert. Meanwhile, those who have only pedagogical secondary diplomas sent by the education sector, declared in the dossier as experts, so they have been entitled benefits by Hai Duong Province under the Decision 62/2015 / QD-TTg above.
Regarding this issue, The Ministry of Labor, War Invalids and Social Affairs gives answers to voters in Hai Duong Province as follows:
According to Clause 2 Article 1 of Decision No. 62/2015 / QD-TTg dated December 4, 2015 amending and supplementing Decision No. 57/2013 / QD-TTg dated October 14, 2013 of the Government’s Prime Minister, The subjects entitled to the regimes prescribed in this Decision are those working for Party, State agencies, armed forces, Vietnam Fatherland Front, socio-political organizations receiving salaries from the budget. The government is sent to work as experts and help Laos and Cambodia according to their requests and employees who are on duty to support experts in Laos and Cambodia, including: Persons who have retired or left to work due to incapacitation but have not been enjoy the allowance regime specified in Clause 7, Article 2 of Decision No. 87-CT of March 1, 1985 of the Chairman of the Council of Ministers on regimes and policies for officials to help Laos and Cambodia. Persons who are on job or on leave, who are waiting for retirement or who have quit.
In Clause 2, Article 3 of Joint Circular No. 17/2014 / TTLT-BLDTBXH-BTC dated August 1, 2014 of the Ministry of Labor, War Invalids and Social Affairs, the Ministry of Finance guides the implementation of one-time subsidies for people who are appointed experts to help Laos and Cambodia under the Government’s Prime Minister's Decision No. 57/2013 / QD-TTg dated October 14, 2013, in case the beneficiary is lost or does not have enough decision to appoint to go to, The decision to return to the above country must have a certificate of professional time in Laos and Cambodia according to the following provisions:
"For beneficiaries working at agencies, organizations and units of the Party, the State, the Vietnam Fatherland Front, socio-political organizations, the certificate of expert time in Laos , Cambodia's subjects must be signed, stamped for certification by heads of agencies, organizations and working units.
For beneficiaries who are not covered by Point as above, there must be a Certificate of expert time in Laos and Cambodia, made according to form No. 02 issued together with this Joint Circular issued by the head of the agency. agencies and units directly send, sign and affix stamps for confirmation ".
Accordingly, for resumes or certifications of the dispatching agency not sent to be experts to help Laos and Cambodia, there is no basis to consider and settle the lump-sum allowance. in accordance with the above provisions.
