Mr. Tien's land plot also did not show the road to the land plot (although the land his father left behind still had an entrance and exit for many generations); the shape and direction were wrong compared to the actual field.

Mr. Tien asked, who is responsible for correcting the errors and paying the financial costs? Can his land division continue?

The Ministry of Natural Resources and Environment responded to this issue as follows:

Article 75 of Decree No. 43/2014/ND-CP dated May 15, 2014 of the Government detailing the implementation of a number of articles of the Land Law stipulates the procedures for land plot separation.

In case the land user discovers that the issued Certificate has errors compared to the actual land plot in use, he/she shall send a petition to the local land management agency (where the land is located) for resolution.

Based on specific cadastral records, the land user shall carry out the procedures for correction, re-issuance due to re-measurement of the area and size of the land plot, revocation of the issued Certificate, etc.

The procedures for correction of the issued Certificate are stipulated in Article 86 of Decree No. 43/2014/ND-CP; The order and procedures for revoking the issued Certificate are stipulated in Article 87 of Decree No. 43/2014/ND-CP.

In case of re-issuance, the order and procedures shall be implemented according to the provisions in Article 76 of Decree No. 43/2014/ND-CP.
