Ms. Duong Thi Quynh (in Hai Phong City) has to pay compulsory social insurance from January 2005 to April 2010 and was closed the social insurance book, from January 2009 to April 2010 because the company owes social insurance, so she is not entitled to social insurance book.

Ms. Quynh had been interrupted by social insurance from May 2010 to June 2012. From June 2012, she paid social insurance at the new unit until the end of 2017.

Ms. Quynh has moved her work to other new unit and paid social insurance from January 2018, when Mrs. Quynh went to the company to ask for a social insurance book to join in the new unit, but the company replied that her social insurance book was notfinalizedfrom January 2009 to April 2010, the old company has not paid social insurance yet.

Ms. Quynhwould like to ask, is the Social Insurance Agency doing right? She wants to finalize her social insurance book from July 2012 to the end of December 2017, what procedures doesshe need to do?

Regarding this issue, Vietnam Social Insurance responded as follows:

According to the provisions at Point 3.2, Clause 3, Article 46 of the process of collecting social insurance, unemployment insurance, labor accident and occupational disease insurance; Management of social insurance and health insurance cards issued together with the Decision No. 595 / QD-BHXH dated April 14, 2017 of the General Director of Vietnam Social Insurance:

For units of social insurance, unemployment insurance, labor accident, occupational accident insurance, if employees are eligible for social insurance or terminate labor contracts, work contracts, the unit is responsible for closing sufficient social insurance, unemployment insurance, occupational accident insurance, occupational diseases including the delayed interest rate as regulated, the social insurance agency certifies the social insurance book to promptly solve social insurance and unemployment insurance for employees.

In case the unit has not fully paid, the social insurance book will be confirmed by the time of payment of social insurance, unemployment insurance, labor accident and occupational disease insurance. After recovering the amount owed by the unit and confirming the supplement on the social insurance book.

In her case, because the old unit owed social insurance and unemployment insurance premiums from January 2009 to April 2010, the social insurance agency did not confirm the total time of social insurance and unemployment insurance on the social insurance book.

Therefore, she contacted and asked the old unit to complete the procedure to confirm the social insurance book by the time the unit paid social insurance, unemployment insurance, labor accident and occupational disease insurance (after recovering the unit amount. If the debt is still in arrears, the supplementary certification will be confirmed in the social insurance book.

After confirming the social insurance book for working time at the debt unit, she can ask the unit to complete the procedures to confirm the social insurance book from July 2012 to December 2017 to continue participating in social insurance and unemployment insurance at the new unit.
