Mr. Tran Van Hoang’s wife (in BRVT Province) has 4 years as a ward-level cadre, paying compulsory social insurance but not paying for the maternity fund. Mr. Hoang is a police officer, paying compulsory social insurance. Mr. Hoang would like to ask, in November his wife gave birth to a child, would he be entitled to a one-time allowance when his wife gave birth? What are the records and procedures needed to apply for benefits?

In Article 38 of the Law on Social Security in 2014, Clause 2, Article 9 of the Circular No. 59/2015 / TT-BLĐTBXH dated December 29, 2015 of the Ministry of Labor, Invalids and Social Affairs details and guides the implementation of a number of articles of the Law on Social Insurance on compulsory social insurance and point c Clause 2 of the Official Letter No. 3432 / LĐTBXH-BHXH dated September 8, 2016 of the Ministry of Labor, Invalids and Social Affairs on the implementation of social insurance according to the Law on Social Insurance 2014 with regulations :

In case of childbirth but the mother is not eligible for maternity benefits or if only the father participates in social insurance, the father pays social insurance for 6 months or more within 12 months before the wife gives birth to the child, the father will receive a lump sum equal to 2 times the basic salary at the month of birth for each child.

Applicants for maternity leave are employees specified in Points a, b, c, d, dd and h, Clause 1, Article 2 of the Law on Social Insurance in 2014.
