According to Point b, Clause 1, Article 5 of the Government's Decree No. 135/2020/ND-CP of November 18, 2020, stipulating the retirement age, from January 1, 2021, the employee has full 15 years or more working in areas with extremely difficult socio -economic conditions according to the list promulgated by the Ministry of Labor, War Invalids and Social Affairs, including working time at the area where the area allowance is 0, 7 or more before January 1, 2021, it may retire at a lower age but not more than 5 years older than the retirement age specified in Article 4 of the Decree.
According to the above provisions, the consideration of working time in areas with extremely difficult socio-economic conditions is from January 1, 2021 onwards. Compared to his case, the period before January 1, 2021, he worked at the area of regional allowance of 0.5, so it was not calculated to consider the retirement conditions at a lower age, if he working in areas with extremely difficult socio -economic conditions as prescribed, it is calculated from January 1, 2021.
