Previously, Basic Joint Stock Company (HCMC) owed money to pay social insurance, so when conducting labor reduction procedures, the social insurance unit closed the book and separate sheet until the time the company paid the social insurance premium.This leads to incorrect process of employees participating in social insurance.Currently the Company has paid the full amount of debt, through the receiving system to respond to the recommendations of the business, the company asked, what procedures should be done to update the employee's payment process on the sheet?

Regarding this issue,the Vietnam Social Security has the following opinions:

Pursuant to the provisions of Clause 3, Article 18 of Decree No. 115/2015 / ND-CP dated 11/11/2015 of the Government detailing a number of articles of the Law on Social Insurance on compulsory social insurance and its guiding documents. With the unit that owes the payment of social insurance and unemployment insurance premium, if the employee is eligible to enjoy social insurance or terminates the labor contract or work contract, the unit shall fully pay the social insurance and unemployment insurance premium, including the late payment interest. According to regulations, the social insurance agency certifies the social insurance book to promptly settle the benefits of social insurance and unemployment insurance for the employees.

In case the unit has not paid in full, it shall confirm that the social insurance book has fully paid the social insurance and unemployment insurance premium, and after recovering the outstanding amount, the social insurance book shall make an additional confirmation on the social insurance book.

Comparing the above provisions, in case Basic JSC still owes the payment of Social insurance and Unemployment insurance premium, if there is any benefits of social insurance and unemployment insurance, the social insurance agency shall only confirm until the time the Company has fully paid the social insurance and unemployment insurance premium. Until the Company has fully paid the debt of social insurance and unemployment insurance, including late payment interest as prescribed, the Company makes a list to request for additional confirmation of the participation process for employees together with the notice of the agency. The social insurance agency (paid to the unit at the time of confirming the social insurance book) sends to the social insurance agency for additional confirmation of the payment process. After the social insurance agency completes the additional confirmation of the social insurance book, it will return to the employee.
