The Ministry of Planning and Investment responded to this issue as follows:

In case a bidding package falls within the quota of competitive offers, the application of open bidding is still encouraged as prescribed in Article 20 of the Bidding Law.

According to Clause 4, Article 5 of Circular No. 10/2015/TT-BKHDT, in case of choosing to apply the form of open bidding, there is no need to explain the reasons for application in the document submitted for approval of the contractor selection plan.
