If, after terminating the contract with the company, the employee still wants to look for a job at another company, during that time, can the employee make an unemployment file and receive unemployment benefits or start a new job? forced to make a retirement file?

If after a period of time the employee cannot find a suitable new job and wants to retire, what should the employee do and where to enjoy the retirement benefits?

In this regard, Ho Chi Minh City Social Insurance replied as follows:

The termination of an employment contract is an agreement between the employee and the employer to terminate the contract in accordance with the provisions of the Labor Code.

After terminating the labor contract, the employee has the right to find another job. During the job search period, he/she will be considered unemployed. The employee will register to receive unemployment benefits according to regulations.

While receiving unemployment benefits and finding a job, the employee must go to the place where he has registered for unemployment benefit and notify him of having a job in order to terminate his/her unemployment benefit as prescribed.

If the employee wants to enjoy retirement at this time, the employee needs to contact the social insurance agency of the district where he/she is residing for specific instructions according to the employee's profile.
