When implementing the project, the investor compensated for the assets on the land of forest trees, so does the investor has to plant forests instead?

The General Department of Forestry, Ministry of Agriculture and Rural Development answered this issue as follows:

The implementation of afforestation has been implemented in accordance with the Decree No. 23/2006 / ND-CP dated March 3, 2006 of the Government on the implementation of the Law on Forest Protection and Development, the Circular No. 23/2017 / TT- Ministry of Agriculture and Rural Development dated November 15, 2017 of the Ministry of Agriculture and Rural Development regulates replanting of forests when changing the purpose of using forests for other purposes.

For the question of Ms. Dang Ngoc Tran, in case the forest area (with the land use right certificate is forest land), the procedures for changing forest use purposes have been approved by the competent authority before the Decree. The effective number 23/2006 / ND-CP is not required to implement the forest planting obligation instead.

In case the forest area (with the certificate of land use right is forest land), the procedures for changing the forest using purpose that have been approved by the competent authority after the Decree No. 23/2006 / ND-CP taking effect must fulfill the obligation to plant forests instead.
