(Chinhphu.vn) –Business automobiles and only used within their own land area are not subject to road charges.

In the past two years, the Pactra Vietnam Company has got a contract to move the internal container to the SDS - Samsung Company with 10 tractors. By the end of March 2018, the Pactra Vietnam Company re-signed the contract with the SDS. The work of Team 10 is guaranteed 24 hours by contract and runs within the Samsung factory.

Recently, due to having to re-register the vehicle, the Pactra Vietnam Company is aware of the regulations on free road use in case it is only used within the land under the management of the business.

Through the receiving and responding system to businesses' recommendations, Mr. Phan Minh Thang, who represents for the Pactra Vietnam Company would like to request authorities to consider free use of roads for 10 above-mentioned tractors to reduce expenses for the Company.

Regarding this issue, The Ministry of Finance responded as follows:

Clause 2 Article 2 of the Circular No. 293/2016 / TT-BTC dated November 15, 2016 of the Ministry of Finance regulating the rates, the regime of collection, remittance, exemption, management and use of road fees prescribes:The automobiles are not subject to road use charges in case:The automobiles do not participate in traffic, do not use roads of the road traffic system, only use within the land under the management of businesses and cooperatives such as: stations, ports, mineral exploitation areas, agricultural, forestry and cars used to test the driving vocational training institutions.

Clause 3 Article 9 of the Circular No. 293/2016 / TT-BTC stipulates:For the automobiles prescribed in Clause 2, Article 2, vocational training centers, cooperatives and businesses (hereinafter referred to as enterprises for short) shall compile dossiers and send them to the Department of Transport. theapplication for certification of automobilesthat not used roads of the road traffic system, only used within the land area of the company and vehicles used for testing owned by the company in the form at the Appendix No. 11 issued together with this Circular.

Based on the above provisions, the automobiles of businesses and only used within their own land areas are subject to no road charges. In case the tractor truck of the Pactra Vietnam Co., Ltd. is leased to the SDS - Samsung for use within Samsung factory, it is not used within the territory of Pactra Vietnam Co., Ltd., therefore, this vehicle is subject to road use fees, the Pactra Vietnam Co., Ltd. pays road use fees for vehicles as prescribed.
