According to Article 26 of Decree No. 110/2004 / ND-CP dated April 8, 2004 on clerical work, the stamping is stipulated as follows:
-. The seal affixed must be clear, straight, proper direction and prescribed ink.
- When affixing seal on signature, the seal must cover over 1/3 signature to the right side
- The affix of seal on annexes attached to main documents shall be decided by the document signer and the seal is affixed on the first page covering a part of name of organ or organization or name of such annexes.
- The affix of seal on joining page or embossing seal on specialized documents and materials shall comply with regulations of the Ministers and Heads of sector managing organs;
Article 49 of the Law on Notarization 2014 stipulates: A notarized document containing two or more pages shall be paginated. For a notarized document containing two or more sheets, every two adjoining sheets shall be appended with an overlapping seal on their inner edges.
At Point b, Clause 3, Article 20 of Decree No. 23/2015 dated February 16, 2015 on issuance of copies from master registers, authentication of copies from originals, authentication of signatures and authentication of contracts and transactions, stipulates: Sign, write full name, stamp of the agency or organization performing authentication and record it in the authentication book. For a copy with 2 or more pages, write the testimony on the last page, if the copy has 2 or more sheets, it must be stamped on the side ...
Clause 2, Article 13 of Circular No. 01/2011 dated January 19, 2011 of the Ministry of Home Affairs guiding the procedures and techniques of presenting administrative documents also stipulates: "The seal is closed in the middle of the right edge of the document. copy or annexes text, partially overlapping sheets of paper; each stamp affixes maximum 5 pages of text ".
Thus, the stamping of the overlap depends on the nature of the document, the provisions of law as well as the regulations of the private sector management agencies.
The hybrid seal is often used in documents, contracts, papers, ... with two or more pages for single-sided documents and three or more pages for two-sided documents.
The affixed stamp is to ensure the authenticity of each sheet in the document, to avoid changing the content in documents submitted during the conclusion of a contract or during the submission of documents to authorities of the state. The concealed closure contributes to ensure the objectivity of the document, avoids the substitution or intentionally falsifying the results shown in the previous document.
