Would like to ask, According to Clause 7, Article 16 of the Consolidated Document 05 / VBHN-BKHCN, products are required to be certified as conformable. The certificate of conformity is valid and does not need additional notice of receipt, is this correct?

The Company has referred to Clause 7, Article 16 of the Consolidated Document No. 05 / VBHN-BKHCN of the Ministry of Science and Technology providing regulations on standard conformity announcement, regulation conformity announcement and conformity assessment method, technical regulations, it is found that content, organizations and individuals announcing the standard conformity only need to provide one of three papers (notice of receipt or certificate of conformity or notice of inspection results of the State on  imported goods).

Regarding this issue, Directorate for Standards, Metrology and Quality of Ministry of Science and Technology gives the following opinions:

According to the Law on Standards and Technical Regulations and Clause 1, Article 12 of the Consolidated Document No. 05 / VBHN-BKHCN (Circular No. 28/2012 / TT-BKHCN and Circular No. 02/2017 / TT- BKHCN), "the subject of declaration of conformity is the product, goods, service, process, environment specified in the national technical regulation issued by the line or sectoral Ministries. specified in local technical regulations promulgated by the People's Committees of provinces and cities directly under the Central Government. Declaration of conformity is a mandatory activity ”.

The Circular No. 02/2017 / TT-BKHCN provides general provisions on conformity announcement activities according to the Law on Standards and Technical Regulations. In particular, in Clauses 2 and 3; Article 1 of Circular No. 02/2017 / TT-BKHCN (Articles 12 and 13 of the Consolidated Document No. 05 / VBHN-BKHCN), depending on the level of risks of products and goods Group 2 that will be subject to management measures. The difference is prescribed in national technical regulations or corresponding legal documents, specifically as follows:

- For products and goods with low-risk, declaration of conformity is made based on the results of self-assessment of conformity of organizations and individuals.

- For products and goods with a high level of risk, the regulation conformity announcement will be made based on the certification results of the designated certifying organization.

- For products and goods outside the above two cases, the conformity announcement will be made based on the certification results of the certifying organizations registered or recognized under the provisions of law.

Therefore, it is recommended that the Company studies the management measures in national technical regulations or corresponding legal documents to implement.
