Mr. Khanh asked, the value of goods and services promoted in the above-mentioned coordinated promotion program is determined to be the value of promoted goods and services of traders whose goods or services are sold or the total value of promotional goods and services of both traders and intermediaries on a transaction?
The Ministry of Industry and Trade responded to this issue as follows:
In case traders providing intermediary payment services/e-commerce trading floors and traders providing goods and services jointly conduct promotions, based on Mr. Khanh's inquiry, the determination the value of goods and services to be promoted shall be based on the determination of the price of the promotional unit of goods and services in the promotion activity.
Currently, the Trade Promotion Department is also conducting research and reviewing current legal documents on promotion as well as the law on prices to clarify and be more specific about determining the recommended value used for promotion in promotional activities for consumers about services in general (including services such as payment intermediaries, e-commerce trading floors as well as other similar services promotion cases).
On that basis, the Trade Promotion Agency will report and propose competent authorities to consider and issue regulations (if necessary) to provide more specific guidance and create favorable conditions for the management agencies. The state as well as businesses apply the law.
